Government Affairs Update
 
CTA’s CEO Shawn Yadon appeared on Fox Business on October 20 to discuss the driver shortage amidst the supply chain crisis, worker shortages across the board, the need for all supply chain stakeholders to step up, and the need for immediate regulatory relief at the state and local levels.
The Hybrid and Zero-Emission Truck and Bus Voucher Incentive Project (HVIP) will open new voucher requests on Thursday, October 28 at 10 AM. This is the 3rd wave of funding that is on a first-come, first-served basis. The total funds are available approximately $62 million dollars. Individual owner-operators, small businesses, and large fleets are all eligible. Each purchaser is limited to requesting 30 vouchers per calendar year, except for drayage fleets, which are each limited to 50 vouchers per calendar year. Funding will be available for zero-emission, and electric Power Take-Off (ePTO), and additional modifiers than increase total voucher amount. The program is broken down into 4 steps:
1. Choose the Vehicle: The Vehicle Catalog features a variety of zero-emission and ePTO options from Class 3-8.
2. Find an Approved Dealer Near You: Participating dealers are listed alongside each vehicle in the Vehicle Catalog.
3. Complete a Purchase Order with Your Dealer: The incentive amount will be included on the PO as an immediate price reduction for you. You’ll pay the invoice minus the discount amount and the dealer will submit the voucher request.
4. You and the Dealer Sign Terms and Condition Forms
The California legislature adjourned for the year on September 10th. 2,776 bills were introduced, with 1,114 being sent to Governor Gavin Newsom’s desk. The Governor had until October 10th to either sign or veto bills and ultimately signed 1,038 pieces of legislation, vetoing just 66. 
Below is an update from the American Trucking Associations' (ATA) President and CEO, Chris Spear, on the Biden Administration's vaccine mandate:
 
"I wanted to update you on the latest developments regarding the Administration’s vaccine mandate proposal, as well provide relevant resources to help your companies navigate this issue.
 
Since OSHA sent its proposed rule—which has not yet been made public—to the White House on October 12, we have been in constant communication with Administration officials to convey our serious concerns over the impact such a policy will have on the trucking industry and our ability to keep the nation’s supply lines moving.
 
This evening, we submitted official comments to the Office of Information and Regulatory Affairs—the White House office responsible for reviewing the draft Emergency Temporary Standard before it can go into effect. Our letter formally requests that the Administration:
 
Exempt truck drivers from the ETS, in the same manner that Canada has in its national vaccine mandate;
Ensure fleets that hold federal contracts are not subject to overlapping, contradictory requirements; and
Allow for a reasonable implementation deadline of at least 90 days.
 
Thanks to data provided by ATA members, we have detailed the grave consequences that a misguided rule would have on our nation’s supply chain, which is already under enormous strain. We have made clear that our industry can ill-afford further disruptions as we carry out the vital work of delivering vaccines, PPE, medical supplies, food, water, gasoline, and other essential goods.
 
It bears repeating that no rule—draft or otherwise—has been made public to date. Although we hope the Administration heeds our concerns, we are prepared to respond to every possible outcome, with all options on the table, including potential legal action if necessary.
 
In the meantime, we have prepared this toolkit, including frequently asked questions, to help you and your employees better understand what is undoubtedly a complex topic and complicated rulemaking process.

Group Asks for Personal Conveyance Limits
PrePass®
The Commercial Vehicle Safety Alliance has petitioned FMCSA for a second time to more clearly define the term “personal conveyance” in hours of service regulations. It is asking the agency to add a maximum distance or time limit to the rules.
