Government Affairs Update

The California Business and Industrial Alliance (CABIA) recently released a first-of-its-kind report authored by former California Department of Industrial Relations Director, Christine Baker and former Cal/OSHA Chief, Len Welsh. The report finds that California’s Private Attorneys General Act (PAGA) has failed employees, employers, and the State.

CABIA’s litigation against the state over PAGA is currently under appeal of the dismissal of CABIA’s Separation of Powers claim.  That claim was dismissed on the pleadings because the trial court felt bound by the CA Supreme Court’s Iskanian decision.

Tom Manzo, Founder, CABIA will provide an overview of the report, update on the litigation efforts and let you know how you can help CABIA’s efforts during the upcoming webinar.
In situations of misuse or abuse of a certain payment method by motor carriers or ‎registration permitting services, it may be necessary to suspend the registrant ‎from paying by that particular payment method. This situation is called a ‎‎“suspended payment method.”‎ This policy defines situations when misuse or abuse of a payment ‎method occurs and the restrictions that will result. | More
In early February, ATA submitted a letter to DOT/CDC requesting guidance on mask applicability to team drivers. DOT recently responded to the inquiry and has provided an updated guidance on this issue:

Team drivers are not required to wear a mask in the cab of a commercial motor vehicle (CMV) if the vehicle occupants are individuals who all live in the same household and are the only persons in the vehicle. The CDC recently issued guidance expanding the exemption for solo drivers to include driving teams from the same household. | More
UCR has developed a new tool to assist potential registrants in learning whether they need to register under UCR. The UCR Decision Tree is available on plan.ucr.gov and is linked below for your convenience. | View Decision Tree Tool

The California Department of Public Health has updated standards for meetings and events starting April 15. The guidelines set standards for meetings based on the county’s color tier status and allow for many more attendees when vaccination or COVID testing is required in order to attend. Indoor gatherings are allowed in Red, Orange, and Yellow tiers when vaccination and testing is used. If vaccinations or testing is not needed to attend, then another policy using social distancing/masks, etc. will be needed. Attendees must also live in California.

Here are the rules for private events (such as receptions or conferences) based on tier status noted in the LA Times:

Purple Tier: Outdoor gatherings are allowed and attendance is limited to 25 people. If everyone is either tested or completely vaccinated, attendance can increase to as many as 100 people.

Red Tier: Outdoor gatherings are limited to 50 people, increasing to 200 if all guests are tested or vaccinated. Indoor activities are allowed, with attendance limited to 100, if everyone is tested or shows proof of full vaccination.

Orange Tier: Outdoor gatherings are limited to 100 people. The limit increases to 300, and indoor activities of up to 150 people are allowed, with full testing and vaccination.

Yellow Tier: Outdoor gatherings of up to 200 people can be held, increasing to 400 if all guests are tested or fully vaccinated. Indoor activities would be allowed with attendance limited to 200 if everyone is tested or inoculated.
