Government Affairs Update
 
Cal/OSHA Standards Board unanimously adopted the COVID-19 Prevention Emergency Rule requiring, among other things, employers to implement and maintain a written COVID-19 Prevention Program, provide employees with PPE, and offer COVID-19 testing at no cost to all employees (during working hours) who had potential COVID-19 exposure in the workplace. After reviewing the proposed regulation, the Office of Administrative Law approved Cal/OSHA’s COVID-19 Prevention Emergency Rule, making it effective immediately. While Cal/OSHA hinted there would be delayed enforcement, the agency has not yet made any clear public statements. Employers are advised to meet the requirements of the rule at this time and document efforts towards compliance in any area where compliance is not yet feasible. | More

California increased the state’s minimum wage. Effective January 1, 2021, the state-wide California minimum wage for employers with 25 or fewer employees will be $13 per hour and $14 per hour for employers with 26 or more employees. | More
FMCSA expanded and extended the Emergency Declaration that was set to expire on December 31. This expanded declaration became effective at 12:00 A.M. December 1 and expires on February 28, 2021. As with previous declarations, emergency regulatory relief is provided from parts 390 through 399 of the FMCSRs, including the hours-of-service regulations. The primary change with this current declaration is the inclusion of vaccine transportation. | More | FMCSA Extension
Under California legislation enacted on September 30, 2020 (Senate Bill 973) large employers must report certain pay and other data to the Department of Fair Employment and Housing (DFEH) by March 31, 2021 and annually thereafter. DFEH anticipates rolling out a secure online reporting system in advance of the 2021 filing deadline. For more information, please see the FAQ and guidance available on the DFEH website.
During the October 1 California Transportation Permit Advisory Council (CTPAC) meeting, Caltrans presented their Draft Transportation Permit Manual Memorandum (TPPM) for their “Virtual Vehicle Inspection” policy change. The TPPM policy converts the vehicle inspection procedures from field inspection to virtual inspection (remote inspection); however, it will not make any changes to extralegal vehicle or load transportation permit eligibility. After receiving and reviewing comments from industry, Caltrans has adopted the Virtual Vehicle Inspection proposal and it is now an official policy of Caltrans. | TPPM | Caltran's website
