Government Affairs Update
 
During Climate Week 2020, Governor Gavin Newsom signed an executive order to eliminate the sale of internal combustion engines by 2035 and accelerate zero-emission truck targets. The order states, "The State Air Resources Board, to the extent consistent with State and federal law, shall develop and propose:
 
1. Passenger vehicle and truck regulations requiring increasing volumes of new zero-emission vehicles sold in the State towards the target of 100 percent of in-state sales by 2035.

2. Medium- and heavy-duty vehicle regulations requiring increasing volumes of new zero-emission trucks and buses sold and operated in the State towards the target of 100 percent of the fleet transitioning to zero-emission vehicles by 2045 everywhere feasible and for all drayage trucks to be zero emission by 2035.

3. Strategies, in coordination with other State agencies, U.S. Environmental Protection Agency and local air districts, to achieve 100 percent zero-emission from off-road vehicles and equipment operations in the State by 2035.

In implementing this Paragraph, the State Air Resources Board shall act consistently with technological feasibility and cost-effectiveness." The truck targets included in the order are in line with CARB’s June Board resolution

“While California’s trucking industry has and continues to be supportive of embracing innovation to help the state meet its ambitious climate change goals, commercially viable zero-emission trucks that can meet the majority of needs in today’s modern supply chain are not currently available even after decades of testing these new technologies," Shawn Yadon, CEO of the California Trucking Association, said in response to the order.
 
“Additionally, there are major gaps in charging infrastructure and incentive funding that must be met before an effective transition can take place. We look forward to working with the administration to identify the billions of dollars a year in incentives and new infrastructure it would take to make the governor’s executive order a reality in the future,” Yadon said. This is a reminder that the changes to the hours of service (HOS) requirements for interstate drivers are effective September 29, 2020. Please note, these changes are for interstate drivers only; California will need to adopt the new rules for intrastate drivers. There is not yet a definitive adoption date for California intrastate.
 
As you may know, the Teamsters filed a petition in July asking FMCSA to reconsider the changes, which the agency denied. The Teamsters have since brought the matter to the U.S. Court of Appeals for the District of Columbia Circuit. FMCSA intends to move forward with implementation at the end of the month. Truck Unit PAC’s Board unanimously voted to contribute to the “No on Prop 15” campaign. Prop 15, the so called “split roll” initiative, would remove 40+ years of Prop 13’s protection against unreasonable property tax hikes for commercial properties. Proponents of this measure see this as the first step in rolling back Prop 13 for all property taxes. Prop 15 will raise the costs of doing business for nearly every CTA member, whether your property is owned or leased. We applaud the Truck Unit PAC Board’s contribution to “No on 15” and encourage all CTA members to contribute to the campaign as we hit the final stretch towards November’s election. 
The California Air Resources Board hosted two virtual workshops - one to discuss the Advanced Clean Fleets rulemaking and one to review the large entity fleet reporting requirements in the Advanced Clean Trucks (ACT) regulation. The staff presentation for the Advanced Clean Fleets rule was released last week and can be viewed here. CTA is actively participating in discussions with ARB staff on fleet rule concepts and will be submitting formal comments when a draft of the proposed rule takes shape. In the ACT workshop, staff provided this presentation and these draft guidelines for the one time reporting requirements. CARB plans to provide a spreadsheet with the survey questions, which fleets must complete and upload to CARB's website. CARB intends to release the guide and the spreadsheet, once finalized, for beta testing ahead of the April 2021 deadline. Fleets that participate in beta testing would satisfy their reporting obligation. Data gathered from the large entity fleet reporting will be used to inform the Advanced Clean Fleets rule.
