The 5th Wheel
Government Affairs Update

CTA will be closed Monday, September 7 in observance of Labor Day
CTA's lawsuit against AB 5 continues in the Ninth Circuit Court of Appeals on September 1, when a panel of three judges will hear oral arguments from CTA and the State on the State's appeal of CTA's preliminary injunction. CTA was granted an injunction in January, preventing the State from enforcing AB 5 as it relates to motor carriers for the duration of the lawsuit against AB 5. The State appealed the injunction and the Sept. 1 hearing will determine whether the injunction remains in place. You can watch the oral arguments on the Ninth Circuit's Youtube channel. Please note, there is a 24-hour delay. CTA will continue to update membership on the status of the lawsuit. We need your support. Help us defeat AB 5 by making a contribution to our legal fund.
Effective Spring of 2021, all Motor Carrier Permits (MCP) must be renewed online. The new online service option, which takes approximately 15 minutes to complete, was developed to save time and provide carriers greater flexibility. This automated process will post data directly to the DMV database and automatically process payments. You can learn more from the DMV’s news bulletin or, if you’re ready to renew, you can do so on the DMV’s website.
In May, WorkSafe filed Petition 583 with Cal/OSHA requesting the Board create an emergency standard (followed by a permanent rulemaking effort) to protect workers from infectious diseases including novel pathogens (e.g. COVID-19). Included in WorkSafe’s petition is draft language for Cal/OSHA to consider when creating the COVID-19 standard. Requirements in the draft standard are covered by CTA’s COVID-19 Illness Prevention Program & Training Manual. Many of the proposed COVID-19 related bills and regulations provide exemptions and liability protections for employers who implement an illness prevention program; as such, CTA recommends that you consider purchasing and implementing CTA's COVID-19 IPP to protect your business, employees and customers.
CARB is holding a virtual public workshop to discuss the Advanced Clean Fleets regulation on September 18 from 10am-3pm. Advanced Clean Fleets is the companion fleet rule to the manufacturer requirements in Advanced Clean Trucks. The goal of the rule is to achieve a zero-emission vehicle (ZEV) truck and bus fleet by 2045 everywhere feasible and significantly earlier for certain market segments such as last mile delivery and drayage applications. | REGISTER
