The electronic logging device (ELD) rule is intended to help create a safer work environment for drivers, and make it easier, faster to accurately track, manage, and share records of duty status (RODS) data.
• Carriers and drivers who are using paper logs or logging software must transition to ELDs no later than December 18, 2017.
• Carriers and drivers who use AOBRDS prior to the compliance date must transition to ELDs no later than December 16, 2019.

Answers to Questions from CTA Members regarding the ELD Rule
Does the Federal ELD regulation cover intrastate carriers?
We have received a few inquiries regarding the Federal Electronic Logging Device (ELD) regulation and whether it applies to CA intrastate carriers. Currently, the rule only covers interstate carriers. Per Section 350.331 Title 49 Code of Federal Regulations, California has 3 years to adopt California statutes/regulations to be compatible with federal regulations. The final ELD rule was effective on Feb 16, 2016. CHP has until Feb 2019 to adopt for Intrastate, however they could implement it earlier. CTA will update accordingly.
Listed below is the difference between interstate and intrastate:
Interstate commerce is when a person drives a CMV:
- From one State to another State or a foreign country;
- Between two places within a State, but during part of the trip, the CMV crosses into another State or foreign country; or
- Between two places within a State, but the cargo or passengers are part of a trip that began or will end in another State or foreign country.
Intrastate commerce is when:
- A person does not meet any of the descriptions above for interstate commerce.
- The cargo or passengers originate in and the final destination is in California.
- A person does not cross state or international borders.
Can a driver use a portable ELD?
Yes. A driver may use a portable ELD. A portable ELD must be mounted in a fixed position during commercial motor vehicle (CMV) operation (CMV) and visible to the driver from a normal seated driving position. This information can be found in the ELD Rule section 395.22(g).
