On Aug. 29, as part of its consideration of a case involving Velox Express Inc. alleging the violation of labor laws in the transportation industry, the National Labor Relations Board determined that the misclassification of employees as independent contractors does not violate the National Labor Relations Act. So what does this mean for contractors?

When nearing completion on a large construction project, general contractors tend to start allocating their administrative resources to the next project. Yet it’s precisely at the end when one of the largest and most important administrative tasks begins: the closeout process. For this reason, and many others, closeouts are persistently inefficient across virtually all construction verticals.

When undocumented workers get hurt on the job, their individual illegal status does not obviate a right to workers’ compensation benefits; it may, however, limit the benefits to which they are entitled. The right to medical care is the same for any construction employee in that if the claimant moves, a doctor needs to be provided within a reasonable distance of his or her home, even if that means providing care outside of the United States.

According to an Associated Builders and Contractors (ABC) analysis of U.S. Census Bureau data, national nonresidential construction spending declined 0.3% in July totaling $776 billion on a seasonally adjusted annualized basis, and increased 0.1% compared to July 2018. The June 2019 estimates were revised upward from $773.8 billion to $778.5 billion.
