At the February 17 Air District Governing Board meeting, the Board supported the staff recommendation and voted to withdraw the NOx portion of the district’s 2020-21 Annual Offset Equivalency Report and begin a rule development to ensure the applicability and offset requirements comply with the federal New Source Review (NSR) requirements.
The rulemaking will seek to amend the district’s NSR rule (Rule 2201). Amendments will be aimed at ensuring federal offsetting requirements will be met on an ongoing basis and that there will be mechanisms in place to ensure projects have the ability to generate or procure the credits necessary to meet offsetting requirements.
CLFP has been involved in this issue since 2019 and will continue to work with the district and other valley industrial stakeholders on the rule modification.
