Late last Friday evening (February 20), sometime between 9:00 p.m. and 1:00 a.m. EST (literally the 11th Hour if you will), the Department of Education filed their memo supporting their own Cross-Motion for Summary Judgment while opposing the Association of Proprietary College’s previous motion. In essence, this motion first defends against APC’s motion by presenting reasonable alternatives that would break the threshold necessary for APC’s motion to be granted, while establishing their own argument that there are no material facts for the court to decide, thus their own Motion for Summary Judgment should be granted. Below is a quick executive summary of their motion. A detailed summary will be forthcoming in the next few days.
