In Vermont, the Senate Finance Committee favorably reported H 684 last week. The occupational licensure reform bill cleared for Senate floor consideration, proposes to change the regulatory model for barbers and cosmetologists from a Board model to an Advisor model. Accordingly, regulatory decisions and oversight would be made by the Director of the Office of Professional Regulation with advice from two advisors from the profession that are chosen by the Secretary of State. As previously reported, the measure also proposes to reduce the hours of instruction for a cosmetology license from 1,500 to 1,000. It will also reduce the hours of instruction for barbering from 1,000 to 750 hours, esthetics from 600 to 500 hours; and nail technician licensure from 400 to 200 hours. In Iowa, the Senate followed the House by voting unanimously last week to authorize the state’s Board of Cosmetology Arts and Sciences to issue temporary permits allowing salons, schools or persons to provide services at non-for-profit events. As of last week, the Department has submitted two of the three sets of proposed revisions to the regulations that are important to our community (State Authorization and Borrower Defenses and Related Issues) to the Office of Management and Budget (OMB) for review. We anticipate that a third submission on GE will be forthcoming from the Department to OMB in the next week or two. OMB will review each of the three submissions, providing comments and recommendations to the Department, which we are able to track on the Office of Information and Regulatory Affairs website (www.reginfo.gov). Once the Department receives the OMB recommendations, they review them as one of the last steps before issuing a Notice of Proposed Rulemaking (NPRM) and providing between 30 - 90 days for public comment. For now, there is little we can do other than monitor the transmission of documents between OMB and the Department and continue to gain as much information as possible from our continuous conversations with Department officials. However, once the NPRMs are published, AACS will immediately review, summarize, and provide the community with information related to the most recent sets of regulations and will strongly urge our entire community to develop and submit responses to each of the three regulatory packages, highlighting the things that we support and the further revisions that could be made to improve upon the regulations.
