After careful review to ensure a fair and efficient process, yesterday the U.S. Department of Education unveiled an improved discharge process for borrower defense to repayment (BDR) claims.

 

"We have been working to get this right for students since day one," said Secretary Betsy DeVos. "No fraud is acceptable, and students deserve relief if the school they attended acted dishonestly. This improved process will allow claims to be adjudicated quickly and harmed students to be treated fairly. It also protects taxpayers from being forced to shoulder massive costs that may be unjustified."

 

For pending claims, no changes were made to the existing approval criteria. Claims that previously would have been approved will still be approved today. However, rather than taking an "all or nothing" approach to discharge, the improved process will provide tiers of relief to compensate former Corinthian students based on damages incurred.

Three months ago, reviews were mixed when U.S. Education Secretary Betsy DeVos announced the imminent rescinding of the Obama administration’s famous 2011 Dear Colleague letter, which provided guidance on Title IX and campus sexual assault and harassment.

 

On the political left, commentators like Lucia Graves argued that DeVos’s move let colleges off the hook and showed disproportionate concern about false rape accusations. Other writers commended DeVos for attempting to balance public safety with due process. Most colleges and universities adopted a "wait and see" response, leaving in place current Title IX procedures, while also awaiting the Department of Education’s promised revised guidance. Meanwhile, the #metoo movement has, of course, brought issues of sexual assault and harassment into the national limelight to an extent that would have previously seemed unimaginable.

Federal Negotiated Rulemaking discussions seeking to revise the gainful employment (as a result of AACS’ successful litigation) and borrower defense to repayment regulations, and the House Committee on Education and the Workforce has completed markup of legislation to reauthorize the Higher Education Act and is preparing for floor consideration early next year!

The ACE Grant Program is a marketing tool available only to AACS Members aimed at increasing your student enrollment. When your school pledges a tuition discount of $500-$1000 to eligible students, AACS will send you daily leads with prospective student names, phone numbers and email addresses. This complimentary program is promoted through different mediums including newspapers, magazines, internet, salons, high school counselors, and other industry partners.
