Tuesday morning, March 8, 2016, the U.S. District Court of Appeals for the District of Columbia affirmed the lower court's ruling denying APSCU's statutory challenges to the gainful employment regulations. In a very short four-page decision, without warrant of a published opinion, the Appellate Court affirmed the U.S. Department of Education's interpretation that it has the authority to regulate in this area and that the arguments put forth by APSCU attempting to show that the regulations put forward are arbitrary-and-capricious were "unconvincing."
