New State Building Codes

The State of Oregon’s Building Codes Division (BCD) released new editions of the Oregon Residential Specialty Code, Oregon Electrical Specialty Code and the Oregon Plumbing Code. Any permits issued in 2018 must meet the new code requirements, which took effect on Jan. 1, 2018.

During the closure a contractor will pour concrete for the west leaf of the lift span deck and balance the counterweight to support the heavier new deck. A two-inch concrete layer will be poured into the top of the new steel grate deck, to provide better traction. The bridge closure is needed because vibrations from traffic can damage new concrete while it cures, or hardens.

How much do workplace environments affect productivity?

City of Portland’s Bicycle Parking Code Update Project

The City of Portland Bureau of Transportation (PBOT) has been working with a stakeholder advisory committee for the past 1½ years (or 18 months) on an update to the Bicycle Parking Code requirements, in Title 33. The code language regulates the required amount, location and design of visitor (short-term) and resident/commuter (long-term) bicycle parking spaces for new and redeveloped buildings in Portland.

Oregon OSHA has instituted plans to comply with the new OSHA Walking Working Surfaces Subpart D regulations

New Benchmarking Reports Show Increases in Income and Expenses

Are your expenses in line with industry trends? According to BOMA International’s recently released benchmarking reports, the 2017 Office EER and 2017 Industrial EER, income and operating expenses in the U.S. increased slightly in both sectors, as compared to last year’s reports. According to two-year trend data of identical office properties between calendar years 2015 and 2016, total income in the office sector increased from $28.93 per square foot (psf) to $30.60 psf, while total operating expenses increased from $8.20 psf to $8.26 psf. While total operating expenses increased by 0.7 percent, not all expenses increased at the same rate—and some remained flat or even decreased. For industrial properties, the results of a similar analysis show that total rental income per square foot increased from $5.61 to $6.12. Total operating expenses increased by 4.9 percent, from $1.42 psf in 2015 to $1.49 psf in 2016.

Efficient Windows Help a Seattle Building Control Comfort and Save Thousands of Dollars Per Year!

With old, single-paned windows, Lake Union Building in Seattle struggled with climate control and energy efficiency. The building’s owner, Henbart LLC, knew an upgrade was needed to reduce energy costs and provide tenants with a more comfortable space. Required Seismic Certification and Special Inspections for Non-structural Components and Designated Seismic Systems, Effective July 1, 2017

Effective July 1, 2017 the Bureau of Development Services (BDS) will start implementing the provisions of the 2014 Oregon Structural Specialty Code (OSSC) section 1705.11.4, requiring special inspections of designated seismic systems, and section 1705.12.3, requiring seismic certification of certain nonstructural components for structures designated as Risk Category III or IV.

METRO Food Scraps and Recyling for Property Managers

The Metro Council is considering a policy concept to require, over time, the separate collection of food scraps (separate from garbage) for larger restaurants, grocery stores and other food-oriented businesses. Food is the largest component of what the greater Portland area sends to landfills, where it decomposes and creates methane, a powerful greenhouse gas. Metro is looking to keep more food scraps out of garbage and put that waste to better use creating compost, energy and fertilizer. Requiring the separate collection of food scraps from certain businesses will have effects on commercial property management firms. Metro staff will meet with BOMA members on Wednesday, July 19, from 7:30 to 9 a.m. in the lobby conference room of the 200 Market Building (200 SW Market St., Portland) to discuss the policy proposal, answer questions and gather feedback on how this policy may affect members and how its application can best serve the needs of BOMA members and their clients while keeping more food scraps out of landfills. Better Naito: A New Way to the Waterfront

Every year the festivals in Tom McCall Waterfront Park draw hundreds of thousands of people. During the peak season between April and November an additional 15,000 more people per day visit the Waterfront. The Better Naito project was first piloted in 2015 to help manage this influx of visitors, create a safe space for people to travel to these events, and to reduce conflicts between people walking and biking and driving along the Waterfront in the summer months. The first Better Naito was a 2-week pilot project developed by Better Block PDX, Portland State University, and a host of community partners. Better Naito will run from April 28 to September 30 in 2017. In October, the posts will be removed and stored for use next summer.

SW Yamhill-Morrison Sewer Repair Project Construction Update

Environmental Services continues a major sewer repair project in downtown Portland to repair public sewer pipes that are between 100-140 years old and in deteriorating condition. The SW Yamhill-Morrison Sewer Repair Project will be in construction from March 15 to May 20, with the most challenging work to be done in May.

Transportation System Development Charge Update

PBOT has completed an update of its Transportation System Development Charge (TSDC) methodology and capital project list. A TSDC is a one-time fee assessed for new development to help fund the cost of capital improvements to serve a growing population. The City of Portland first adopted TSDCs in 1997 and last updated the methodology and project list in 2017. A public hearing on the TSDC update has been scheduled for July 26th,�at 2 p.m. in Council Chambers, 1221 SW 4th�Avenue, Portland, Oregon. The proposal to City Council on July 26th,�will include adoption of the attached rate study and project list, establishment of TSDC rates, and updates to City Code 17.15, Transportation System Development Charges.�

BOMA International Honors BOMA Oregon at Winter Business Meeting

During the Board of Governors meeting at the recent Winter Business Meeting, BOMA International recognized four BOMA local associations for their excellence in grassroots and issues advocacy through the Government Affairs Awards of Recognition Program, popularly known as the "Govies." BOMA/Oregon was honored for Outstanding Single Government Affairs Issue – Small BOMA Local Association for being a leading member of the Safe and Livable Portland Coalition, a group composed of neighborhood associations, nonprofits and local businesses that want real solutions to Portland’s housing and homelessness crisis. The coalition filed suit against the city and the Mayor of Portland over his decision to permit sleeping on Portland sidewalks, calling the pro-camping policy an illegal abuse of power. After six months, the Mayor ended his experiment of allowing the homeless to camp on the streets of Portland. The coalition said that "The Mayor’s policy failed, in part, because he ignored the voices of affected Portland residents and businesses." In particular, BOMA/Oregon emphasized that a new solution needs to be crafted by the City Council that includes public feedback and considers public safety.

The Advanced Rooftop Unit Campaign (ARC), in partnership with the U.S. Department of Energy’s Better Buildings Alliance, wants to recognize your energy efficiency efforts. Building owners and managers who have increased their energy efficiency through the installation of high-efficiency rooftop air conditioning units (RTUs) or advanced RTU controls can celebrate their savings to their bottom line and sustainability efforts by applying for recognition.

60 Minutes Features Story on "Drive-By" ADA Lawsuits

Earlier this month, 60 Minutes featured a segment detailing the growing trend of lawsuits filed against businesses around the U.S. relating to the Americans with Disabilities Act (ADA). Host Anderson Cooper demonstrated how attorneys file lawsuits after simply driving by a business or looking at satellite imagery of a building to spot highly technical accessibility issues. This segment brought much-needed attention to the issue, which BOMA International has been working hard to remedy with the help of lawmakers. BOMA’s advocacy team currently is working in support of federal legislation that protects commercial buildings from this harmful practice through the introduction of a "notice and cure" period that allows building owners 120 days to correct identified ADA violations before the commencement of litigation. This provision upholds the intent of the ADA, which is to foster an accessible environment for individuals with disabilities. And the proposal does nothing to help make homes any more energy efficient.

Construction Excise Tax

A number of business groups are strongly urging the Portland City Council to slow down on the construction excise tax until further analysis can be done. The proposal is to levy a CET of 1 percent of permit valuation. The City must take more time to thoroughly evaluate the impacts this will have on development, both residential and commercial.

Portland Parks System Development Charge — Update

Ruling in Portland Parks SDC lawsuit recognizes City’s error, but gives unprecedented privilege to City; appeal likely Portland’s controversial Parks funding plan took a hit as a Multnomah County Circuit Court judge ruled on May 18, 2016 that the City of Portland did not properly address and account for the new costs it imposed on new homes and jobs with its recently adopted Parks System Development Charge (SDC) structure. The ruling came as a result of a challenge put forward by a coalition of business organizations in Portland, following City Council’s 3-2 vote in May 2015 to adopt significantly higher fees for Parks development.

Mayor Hales proposes 14% increase of the Business License Tax!

PORTLAND, Ore. - Portland mayor Charlie Hales said he wants to raise the Business License Tax, generating an additional $8.7 million a year. He made the announcement as he outlined the details of his proposed 2016-2017 budget during a press conference outside City Hall Monday. About 25,000 will see an increase ranging from $61 to $1,532 a year.

Noise variance fee increases for 2016

The Office of Neighborhood Involvement is proposing increases across the board for all noise variance fees. These are the fees the city charges applicants to ask for a variance from the Portland Noise Code, or Title 18. These new fees would go into effect for the new fiscal year starting on July 1, 2016. The Noise Variance Board meets today and again on Monday, May 16, 2016. Written comments will be accepted until the end of day on Tuesday, May 17th.

We last met with Samir Mokashi from CODE UNLIMITED in 2012. As you know, there are changes/updates we all should be aware of ? and Samir is the go-to person for ADA questions. BOMA strongly supports the "next generation" of accessibility requirements in new buildings and alterations while "grandfathering" conditions that meet current Department of Justice standards (2010 ADA Standards). BOMA continues to work to ensure that new regulations, codes and standards provide increased consistency in accessibility requirements, offer more reasonable and clearer technical requirements and lead to more consistent interpretation, application and enforcement.

Conservation Advisory Council Operating Principles 2015 The Conservation Advisory Council (CAC) is one of several standing committees formed by the board of directors to provide advice in support of the Energy Trust efficiency programs. From the CAC Charter: The purpose of the Conservation [and Renewable] Advisory Councils is to advise the board and staff of Energy Trust of Oregon, Inc., regarding issues associated with Energy Trust energy efficiency and renewable energy policies and programs. The Councils will: (a) Review and discuss selected energy efficiency and renewable energy issues prior to Energy Trust decision-making to ensure that the Board and staff have the best available information on such issues; (b) Help the Board and staff to identify alternative resolutions of such issues; and (c) Help staff identify matters for board consideration. The CAC provides direct advice and input on budgets, program designs and strategies and the implications and programmatic response to policy or market changes. Final resolution of issues and all decision authority remains with the board of directors. The following operating principles are a distillation of Conservation Advisory Council meeting discussions concerning the CAC role and meeting process. CAC Operating Principles were initially developed in 2004 to improve and enhance the CAC process. The Operating Principles are reviewed by CAC members and Energy Trust staff at the beginning of the year, updated as needed and adopted. The following items were generally agreed to be the way that CAC should operate in 2015. Energy Trust staff has endeavored to incorporate these principles into the CAC meeting process as a way to enhance the effectiveness of advisory council meetings. 1. Meet in person at least 8 times per year, providing a phone conference line upon request if a CAC member needs to participate remotely. 2. Draft an annual CAC schedule to set expectations for the year and prioritize known issues/ topics for the year to inform annual schedule and meeting agenda development. 3. Whenever possible, distribute meeting agendas, related materials and notes from the previous meeting one week in advance so that CAC members can review and be prepared to engage on topics. 4. Identify agenda items as discussion, information or recommendation needed. 5. Make presentations short and succinct; provide ample time for discussion. Structure the meetings to maximize dialogue between staff, CAC members and other interested parties who attend. 6. Assure sufficient CAC member input and discussion on warranted topics before polling members for opinions. Document minority viewpoints as well as prevailing opinions. 7. Provide summaries of CAC input in board briefing materials or decision documents where applicable. Summaries should reflect the degree of CAC unanimity. 8. Encourage board member attendance at CAC meetings. Include board members on CAC distribution list to allow board to review CAC minutes and to choose to attend meetings of interest. 9. Include time on agendas for open discussion and suggestions for future agenda items. 10. Brief new, incoming CAC members on their duties.
