BOMA Facts

During July and August, the City Council tends to slow down in terms of holding regular hearings on legislation, but of course policy issues continue to happen and proposed legislation continues to be negotiated, and of course matters can arise at the State or Federal levels. 

As an example, we are well aware that the Department of Health enforcement regarding legionella and cooling towers continues to be an issue. We are working to set up a meeting with upper management at DOH and a small contingency of our members to discuss these problems. On the legislative front, the City Council is looking for input regarding legislation to reduce emissions from existing buildings as part of the City’s 80 x 50 program. We will continue to discuss these initiatives with them to seek common sense, reasonable approaches.

Last, at the State level, the Department of Conservation is proposing to revamp its Part 360 rules regarding the handling and management of fill material, particularly excavated soil. The new proposals, as written, would impact construction in ways that are unnecessary and problematic. BOMA/NY submitted comments on the proposal calling out these and other issues and offering to work with the City and State to find better solutions. We are awaiting their response.
