In a new bank merger policy statement approved by the FDIC, the agency said that credit unions may need to provide additional information when applying to acquire an FDIC-insured institution, as credit unions are not subject to the Community Reinvestment Act.
 
The Justice Department announced that it would no longer use its 1995 bank merger guidelines and instead rely on its 2023 merger guidelines to review proposed mergers across all industries, including banks. It also released commentary explaining the application of the 2023 guidelines in banking.
 
The ABA and six financial industry associations said that they continue to oppose a proposed data privacy bill that would conflict with privacy requirements already in place for banks and other financial institutions.

The ABA recently raised several concerns about proposed changes to a Treasury Department program that invests in community development financial institutions and minority depository institutions so they can increase financial support to communities hard hit by the COVID-19 pandemic.
 
The FDIC board unanimously voted to advance a proposed rule to establish new recordkeeping requirements for banks that enter into arrangements with third-party fintech firms to provide deposit products and services. 
 
The Consumer Financial Protection Bureau has released an FAQ about applying Truth in Lending regulation to buy now, pay later products. The bureau in May issued an interpretive rule defining lenders who provide BNPL products as credit card providers under the Truth in Lending Act and its implementing regulation, Regulation Z.
