March 2014

Dear ASHHRA Colleagues,

Coming in like a lion wasn’t limited to the weather this March. Those of us in human resources (HR) have been challenged by the potential roar caused by a significant proposed change in union election rules. The National Labor Relations Board (NLRB) has proposed new rules that would (1) substantially shorten the period between when a representation petition is filed with the NLRB and an election is held; and (2) require employers to more quickly provide unions with employees’ contact information. Many of you may already have received details from your legal colleagues. If you would like to have one more quick analysis, Roger King, a long-time supporter of ASHHRA, and an esteemed member of the Jones Day law firm has crafted information for you regarding the NLRB’s proposed new election rules. The information is included here for your reference.

Please Note: The Board set a deadline of April 7, 2014, for the submission of public comments to the proposed amendments, with reply comments to be filed by April 14. The Board also said it will hold a public hearing during the week of April 7, at which members of the public may address the proposed amendments and make other suggestions for improving the Board’s representation case procedures. For a copy of the NLRB's Notice of Proposed Rulemaking, and information on how to submit comments concerning the same, click here.

With all the challenges we are facing, having help to stay abreast of these potential changes is essential. Hopefully you all are starting to experience a change in the weather, literally, and looking forward to sunnier days ahead. Here’s hoping we get to experience March going out like a lamb!
