Annual Immigration Report Due December 31

Print this Article | Send to Colleague

The Immigration Report is a mandatory report required by state law. It applies to all state agencies, counties, cities, and local authorities. Since this law was enacted in 2011, every county has submitted a report each year. The Department of Audits and Accounts (DOAA) serves as the state agency in charge of overseeing the reporting system and can assist with access issues (username/passwords) and technical assistance in uploading report information.

To access the submission portal, click here. If your county has had staff changes and does not have access to the reporting system, you will need to contact DOAA at Immhelp@audits.ga.gov and ask for credentials (password/username) to access the system. Once you receive the credentials you will have access to this year’s report as well as previous year’s reports filed by your county. Information on how to create an account is available here.

What’s in the Report:
The report requires counties to submit the following information: E-Verify number and authorization date, E-Verify contractor information, E-Verify private employer information, and public benefit information. The report also requires each county to certify that it is compliant with state law regarding sanctuary policies.  A specific overview on how to complete the sanctuary policy question (which is the most likely section to be answered incorrectly) is included here. The report instructions with a breakdown of what information under each category needs to be submitted is available here

What Happens if Your County Does Not File the Report:
DOAA will be reporting non-compliant counties to state agencies that provide state funding to local governments (e.g., GDOT, DCA, etc.), which means your county will not be eligible for grant funding from these agencies if you fail to complete the report.  As such, the report needs to be filed by December 31, 2023 to avoid penalties.

Who Should File the Report on Behalf of the County:
This will vary based on county. Some counties use multiple departments to complete the report, which may include the purchasing department, occupation tax certificate (business license) department, etc. Other counties use one person such as the manager/administrator or clerk to complete the report. It is up to the county as to who should participate in the preparation of this report. It is recommended that your county review what is required and determine the best staff to complete this task. If there are any questions as to which documents/information should be included, please contact your county attorney.
