AAPA’s Port Leasing Workshop Exceeds Expectations

AAPA’s Port Property and Terminal Lease Workshop, hosted Sept. 21 by the Port of Houston Authority, attracted more than 75 registrants for a focused look at port leasing trends, lease policies and structures, and legal and regulatory limitations on port leases, such as the Shipping Act.  

Inspiration for the workshop came from survey feedback received following AAPA’s Port Real Estate Seminar last December in San Pedro (CA). The survey responses indicated interest in a "deep dive" into the crafting of port property and terminal lease agreements.

Workshop presenters included port attorneys, finance executives and real estate managers as well as port consultants. Kathryn McDermott, a maritime real estate and business development consultant previously with the Port of Los Angeles, spoke about leasing policies, while Franc Pigna, managing director for Aegir LLC Port Property Advisors, and Spencer Stewart, industry principal for Yardi Systems Inc., focused on the nature and structure of commercial waterfront development leases.  

Debra Tsuchiyama Baker, managing partner with Baker Wotring LLP in Houston, discussed general lease provisions, lease terms and language, and lessor/lessee responsibilities. Her firm also sponsored the workshop lunch.

Other highlights were presentations on the legal and regulatory limitations of port leases by partners in three Washington, D.C., law firms Jonathan Benner of Thompson Coburn LLC, Paul Heylman of Saul Ewing LLP; and John Longstreth of K&L Gates LLP.
