States pass bills to curb ADA drive-by lawsuits

In the last month, the states of Arizona, Florida and Texas each enacted major ADA reform bills to curb predatory "drive-by" lawsuits. The Arizona legislature passed SB 1406 to enact a 30-day "notice and cure" period for state disability lawsuits, and the Texas legislature passed HB 1463 to enact a similar 60-day provision. This will ensure that business owners will be notified of alleged accessibility barriers before pursuing costly litigation. In addition, the Florida legislature passed HB 727, a bill that creates an ADA certification program to create actionable solutions for small businesses.
