The California Rental Association (CRA) and the ARA of CA had a well-attended San Francisco Bay Area Territory Meeting at the end of October. The meeting was hosted by RGW Equipment at their facility in Livermore, CA. RGW provided delicious appetizers and a BBQ feast. RGW also displayed many pieces of equipment they sell and service, as well as equipment of their vendor partners. CRA and vendors alike provided many raffle gifts, with the proceeds of the raffle to be split between CRA's foundation, Rental Service Industry Foundation (RSIF), and the ARA's foundation. Both organizations encouraged participation at their upcoming trade shows, the CRA Rental Rally in Las Vegas, January 26-28, 2016, and the ARA Rental Rally in Atlanta, GA, February 21-24, 2016.

The following information was provided by Gabe Marquez of the Southern California Crime Prevention Program. On the morning of October 14th, the Crime Prevention Program received a call from JF Shea Construction, a CPP member. The call was regarding the theft of a 2007 KW water truck in Pico Rivera which occurred sometime during the night. The truck was not GPS or LoJack equipped and I was thinking this truck could be at the border, getting ready to be shipped at the port or on a lowboy to somewhere. Before the day was over, a stolen bulletin was created with a picture of a very similar truck in the JF Shea fleet. This bulletin was sent to over two hundred law enforcement e-mail contacts and to the CPP members.

CalChamber, Coalition Blast Deceptive Ballot Measure
The California Chamber of Commerce is leading a coalition to stop a November 2016 ballot measure that threatens to significantly disrupt infrastructure development, jobs and the economy in California. The Secretary of State announced on Monday that supporters of the initiative, including the proponent, Stockton-area farmer and food processor Dean Cortopassi, had submitted enough signatures to qualify the measure for the ballot. The measure amends the state Constitution to require statewide voter approval for revenue bonds used to build California infrastructure projects exceeding $2 billion. The growing coalition, Citizens to Protect California Infrastructure, includes labor, business, water, family farmers, environmentalists, and other organizations that have come together to defeat the Cortopassi initiative.

Roughly 9,000 California companies moved their headquarters or diverted projects to out-of-state locations in the last seven years, and Texas has been a prime beneficiary of the Golden State’s "hostile" business environment. That’s the conclusion of study by Joseph Vranich, a site selection consultant and president of Irvine-based Spectrum Location Solutions. Of the 9,000 businesses that he estimates disinvested in California, some relocated completely while others kept their headquarters in California but targeted out-of-state locations for expansions, Vranich found. The report did not count instances of companies opening a new out-of-state facility to tap a growing market, an act unrelated to California’s business environment.

The Short-Term Energy Outlook released on November 10 forecasts average North Sea Brent crude oil prices of $54/barrel (b) in 2015 and $56/b in 2016. Forecast West Texas Intermediate (WTI) crude oil prices average $4/b lower than the Brent price in 2015 and $5/b lower in 2016. Current values of futures and options contracts continue to suggest high uncertainty in the price outlook (Market Prices and Uncertainty Report). Based on contracts traded during the five-day period ending November 5, the lower and upper limits of the 95 percent confidence interval for the market's expectation of monthly average WTI prices are estimated at $35/b and $66/b for February 2016 widening to $28/b and $95/b for December 2016 (Figure 1). Key market uncertainties include the pace and volume at which Iranian oil reenters the market, the strength of oil consumption growth, and the responsiveness of non-OPEC production to low oil prices.

The November 6 CalChamber newsletter reported that, according to the State Water Resources Control Board, Californians reduced water use by more than 26 percent during September. The conservation rate exceeded the Governor’s 25 percent mandate for the fourth month in a row. The 26.1 percent statewide savings rate for September equates to 165,233 acre-feet/53.8 billion gallons, and was a decrease from the 27 percent savings rate in August, the board said.

According to a recent article on www.reuters.com, Southern California's biggest drinking water supplier will seek an option to buy 20,000 acres of river delta farm land east of San Francisco, a deal that could benefit a controversial tunnel project to carry Northern California water southward, the agency said on Tuesday. Officials at the Metropolitan Water District (MWD) of Southern California denied criticism that the move portends a land-water grab in a region long suspicious of efforts in the drier southern part of the state to gain more water from the north.

An initiative filed November 12 by Board of Equalization member George Runner and State Senator Bob Huff would add an amendment to the California Constitution to make a priority of irrigation and drinking water. To pay for new water storage facilities without raising taxes or adding new debt, the initiative proposes using $8 billion of the unspent portion of the nearly $10 billion rail bond approved by voters in 2008. In addition, the proposed measure calls for moving $2.7 billion of the water bond passed in 2012 for specified water storage purposes.

Truck and Bus Regulation: On-Road, Heavy-Duty Diesel Vehicles (In-Use) Regulation
The regulation requires diesel trucks and buses that operate in California to be upgraded to reduce emissions. Lighter and older, heavier trucks must be replaced starting January 1, 2015. By January 1, 2023, nearly all trucks and buses will need to have 2010 model year engines or equivalent. The regulation applies to nearly all privately and federally owned diesel-fueled trucks and buses and to privately and publicly owned school buses with a gross vehicle weight rating (GVWR) greater than 14,000 pounds.

The small off-road engine (SORE) category consists of off-road, spark-ignition engines below 25 horsepower, including small utility equipment, lawn mowers and weed trimmers. This category does not include compression-ignition engines, watercraft or recreational vehicles. On July 26, 2007, the Air Resources Board (ARB) adopted a regulation to reduce diesel particulate matter (PM) and oxides of nitrogen (NOx) emissions from in-use (existing), off-road, heavy-duty diesel vehicles in California.

A Fleet Average Calculator for Small Fleets has been made available for public use. The Small Fleet Average Calculator is for small-sized off-road fleets (2,500 or less total horsepower) and covers all compliance years. The calculator is available here. Fleet owners utilizing the calculator are advised to first read the User Guide in order to familiarize themselves with the calculator.

This area of the Off-Road Mobile Sources website pertains to off-road, large spark-ignition (LSI) equipment greater than 25 horsepower, including farm, construction and industrial equipment, powered by gasoline and liquefied petroleum gas (LPG) and other alternate fuels. Typical applications that use LSI engines include forklifts, specialty vehicles, airport service vehicles, large turf-care equipment, portable generators and a wide array of other agricultural, construction and general industrial equipment. The U.S. EPA has sole authority to control new farm and construction equipment under 175 horsepower.
Posted September 25, 2015: Public Workshops To Discuss Proposed Amendments To The Off-Road Large Spark-Ignition Engine Fleet Regulation
Staff is developing a proposal to require reporting and labeling, similar to the existing In-Use Off-Road Diesel-Fueled Fleets Regulation, for equipment covered by the LSI Fleet Regulation. Additional minor clarifications are also being proposed. The proposed amendments are critical to providing needed inventory updates, facilitating uniform compliance, and identifying incentive opportunities. Staff is also interested in hearing from affected stakeholders on alternatives to achieving these same objectives. The ARB's Heavy-Duty Vehicle Inspection Program and Periodic Smoke Inspection Program were adopted into law in 1988 to control excessive smoke emissions and tampering from heavy-duty diesel trucks and buses. The regulations Title 13 CCR, sections 2180-2189 for HDVIP and Title 13 CCR, sections 2190-2194 for PSIP, which govern these programs, were last amended in 2013.

The HDVIP program requires heavy-duty trucks and buses to be inspected for excessive smoke and tampering and for engine certification label compliance. Any heavy-duty vehicle traveling in California, including vehicles registered in other states and foreign countries, may be tested. Tests are performed by ARB inspection teams at border crossings, CHP weigh stations, fleet facilities and randomly selected roadside locations. Owners of trucks and buses found in violation are subject to minimum penalties starting at $300 per violation.

The Truck and Bus Regulation will reduce diesel-exhaust emissions from privately owned and federal government diesel trucks and buses. Privately and publicly owned school buses have different requirements and do not need to be reported. This CARB site has the Truck Regulations Upload and Compliance Reporting System (TRUCRS).

Owners or operators of portable engines and certain other types of equipment can register their units under the Air Resources Board's (ARB) Statewide Portable Equipment Registration Program (PERP) in order to operate their equipment throughout California without having to obtain individual permits from local air districts.

Portable Diesel Engine Airborne Toxic Control Measure
On January 1, 2013, the Portable Engine Airborne Toxic Control Measure (ATCM) fleet emission standards went into effect. The ATCM required owners of portable engines to submit a Fleet Compliance Report to the Air Resources Board by March 1, 2013. The next Fleet Compliance Report will be due March 1, 2017.

EMERGENCY EVENTS
Butte and Valley Fires:
Notification within 24 hours of operation is required for portable engines operating equipment where the portable engine is not permitted (if required), or registered in PERP, and the equipment is operating in support of fire-fighting and/or related clean-up activities in Amador and Calaveras counties (Butte Fire) and Lake and Napa counties (Valley Fire). The notification form is available here and should be mailed to the above address, or sent via email when beginning operation at each location.
Drought Related Projects: Notification within 24 hours of operation is required for water well drill rigs, water pumps, or project-related equipment where the portable engine is not permitted, or registered in PERP, and is operating during California's drought emergency.
