Two new TS diesel towable generators are available from Baldor Generators. The TS500 and TS190 are powered by John Deere engines and meet Interim Tier 4 EPA emissions regulations. The engines are fitted with a diesel oxidation catalyst (DOC) and a diesel particulate filter (DPF) to minimize any harmful exhaust gasses given off during operation.

Chicago Pneumatic sales representatives received hands-on training experience with compaction equipment at the company’s recent training event at its North American distribution facility in Charlotte, N.C. The training had an in-depth focus on the features and benefits of the entire Chicago Pneumatic Construction Equipment line. Twenty-five representatives participated in the training, taking part in hands-on educational sessions on CP’s construction equipment. Kubota Tractor Corporation has received the No. 1 rating and "Dealer’s Choice Award" among Major Tractor Manufacturers, according to the North American Equipment Dealers Association (NAEDA) 2013 Dealer-Manufacturer Relations Survey. With around 530,000 visitors from 200 countries, the 2013 Bauma has broken the previous visitor records. Wacker Neuson is also very pleased with the result of the trade fair. The California Chamber of Commerce reported in the May 10 Alert Newsletter that a federal court of appeals struck down a National Labor Relations Board (NLRB) rule requiring most companies to post a notice informing employees of their union rights. The controversial poster rule required most private sector employers to put up NLRB-created workplace posters entitled "Employee Rights Under the National Labor Relations Act."

A California Chamber of Commerce-opposed bill that completely undermines the legal significance of the independent contractor relationship passed a Senate committee on May 8, reported the May 10th California Chamber of Commerce Alert Newsletter. SB 556 (Corbett; D-San Leandro), newly identified as a "job killer," unfairly imposes liability on any contracting entity for the damages caused by the contractor or contractor’s employees, including wage-and-hour violations, penalties, fines, and willful misconduct, solely on the basis that the contractor or its employees wore a uniform similar to that of the contracting entity or drove a vehicle with the contracting entity’s logo.

The following article by Tom Scott, Executive Director of California Citizens Against Lawsuit Abuse, appeared on foxandhoundsdaily on May 13. In its ninth annual survey, Chief Executive magazine polled 736 CEOs – the highest number ever – about the best and worst states in which to do business. The survey asked business leaders to grade states based on the following metrics: taxation and regulation, quality of workforce and living environment. California placed dead last – the same rank it received in 2012 – right behind Illinois and New York. Texas ranked No. 1, followed by Florida, North Carolina and Tennessee.

Mexico is a net exporter of oil by the broadest measure that encompasses both crude oil and petroleum products. However, like many other major oil producing countries, it depends on cross-border and global trade to meet its need for petroleum products. Most of Mexico's petroleum trade is with the United States, the destination for most of Mexico's crude exports and the source of most of its refined product imports. Since reaching a peak of nearly 3.4 million barrels per day in 2004, Mexico's crude oil production has declined each year, although at a slower rate since 2010.

The following is from Chris Reed, San Diego Union Tribune editorial writer and former host of KOGO Radio’s "Top Story" weeknight news talk show, and appeared on foxandhoundsdaily.com on May 10th. Last month’s Los Angeles Times’ bombshell about the state bullet-train project could scarcely have made those in charge of the California High-Speed Rail Authority look worse. The Times reported that in determining who would be chosen to build the first segment of the project from Madera to Fresno, a rail authority committee — after a long, well-publicized public hearing — decided to emphasize competence and design skills by ruling that only the three contractors rated highest in this area would be considered. But the rules were subsequently changed with the bare minimum of publicity. The result was the authority’s favored bidder was the one with the cheapest bid. It was Sylmar-based Tutor Perini — a consortium which had the worst "technical" ranking of any bidder and would have been ineligible under the original rules.

This area of the Off-Road Mobile Sources website pertains to off-road large spark-ignition (LSI) equipment greater than 25 horsepower and powered by gasoline and liquefied petroleum gas (LPG), and other alternate fuels – forklifts, airport service vehicles, large turf care equipment, portable generators, and other agricultural, construction and industrial equipment. ARB has received U.S. Environmental Protection Agency authorization to enforce the Large Spark-Ignition Engine Fleet Requirements Regulation (LSI Fleet Regulation), including the fleet average emission level standards. Enforcement Advisory 441 announces that all provisions of the LSI Fleet Regulation are enforceable and that ARB intends to commence enforcement of all its requirements. ARB has updated the LSI Fleet Regulation tutorial to reflect regulatory changes that were adopted in December 2010. These changes became effective December 14, 2011.

What's New? By March 1, 2013, large fleets must submit a signed Responsible Official Affirmation of Reporting (ROAR) to ARB. By the same date, large fleets must designate appropriate vehicles as low-use for 2012, and submit hour meter readings. Also, as of March 1, 2013, fleets will no longer have the ability to use the "Oops Unsell" or "Oops Restore" features for vehicles and engines removed in 2012. Similarly, fleets will no longer be able to move vehicles among fleets in their DOORS account using the "Reassign Vehicle" function, nor to change how their fleet portions are aggregated using the "Aggregate Fleet" function. Fleets under common ownership or control must decide now if/how they want to apportion themselves and ensure that parent fleets are reported properly.

Owners or operators of portable engines and certain other types of equipment can register their units under the Air Resources Board's (ARB) Statewide Portable Equipment Registration Program (PERP) in order to operate their equipment throughout California without having to obtain individual permits from local air districts. Revisions were made to the PERP Regulation and Portable Engine Airborne Toxic Control Measure (ATCM) which became effective on February 19, 2011. All holders of PERP Registrations are now subject to these requirements. On July 1, 2012, to apply for initial registration in PERP, all non-flex diesel engines rated 50 bhp and above must be certified to the interim Tier 4 emission standard. The fleet standards from the Portable Engine ATCM take effect January 1, 2013.

The regulation requires diesel trucks and buses that operate in California to be upgraded to reduce emissions. Heavier trucks must be retrofitted with PM filters beginning January 1, 2012, and older trucks must be replaced starting January 1, 2015. By January 1, 2023, nearly all trucks and buses will need to have 2010 model year engines or equivalent. The regulation applies to nearly all privately and federally owned diesel fueled trucks and buses and to privately and publicly owned school buses with a gross vehicle weight rating (GVWR) greater than 14,000 pounds. Small fleets with three or fewer diesel trucks can delay compliance for heavier trucks by reporting and there are a number of extensions for low-mileage construction trucks, early PM filter retrofits, adding cleaner vehicles and other situations.

The Truck and Bus Regulation will reduce diesel exhaust emissions from privately owned and federal government diesel trucks and buses. Privately and publicly owned school buses have different requirements and do not need to be reported. The ARB's Heavy-Duty Vehicle Inspection Program and Periodic Smoke Inspection Program were adopted into law in 1988 to control excessive smoke emissions and tampering from heavy-duty diesel trucks and buses. The regulations, title 13 CCR, sections 2180-2189 for HDVIP, and title 13 CCR, sections 2190-2194 for PSIP, governing these programs were last amended in 2007. The HDVIP program requires heavy-duty trucks and buses to be inspected for excessive smoke and tampering, and engine certification label compliance. Any heavy-duty vehicle traveling in California, including vehicles registered in other states and foreign countries, may be tested. Owners of trucks and buses found in violation are subject to minimum penalties starting at $300 per violation.
