In September, Atlas Copco Secoroc LLC announced it had agreed to acquire U.S. based NewTech Drilling Products, LLC. The acquisition adds a new type of high-quality product to the Swedish industrial group’s offering for mining and oil and gas drilling. Based in Salt Lake City, Utah, NewTech develops and manufactures drilling products with a focus on rotary PDC (polycrystalline diamond compact) drill bits as well as klaw bits for rotary soft rock mining. These durable tools are designed to be both impact and wear resistant and the PDC bits are particularly suited to shallow, land-based drilling applications. NewTech, which is privately owned, currently employs 20 people and had revenues in 2011 of MUSD 6.5 (MSEK 45).

The Toro Company is announced in October its partnership with Yanmar America Corp. Yanmar will provide diesel engines for select Toro commercial turf maintenance equipment. The Yanmar diesel engines will allow Toro to comply with the U.S. Environmental Protection Agency's Tier 4 emissions regulations, which go into effect January 1, 2013. Yanmar will provide Toro with EPA compliant diesel engine models. The low total lifecycle ownership cost of Yanmar's diesel engines along with innovative technology and reduced environmental impact were deciding factors in Toro's decision to form a partnership with Yanmar. The first Toro products to feature Yanmar's Tier 4 compliant diesel engine technology will be select commercial mowers over 25 horsepower.

Briggs & Stratton Corporation announced October 1 that it will complete its delivery of nearly $1 million in donated generators and pressure washers to an additional 58 American Red Cross chapters nationwide. The donation will help areas prone to hurricanes, tornadoes, ice storms and other severe weather to be ready for recovery efforts before disasters hit. This second phase is timely as the winter weather season approaches.

In November, Wacker Neuson announced revenue increases in third quarter of 2012 and that in the first nine months of 2012, Group revenue rose 12 percent to EUR 812.6 million (9M 2011: EUR 727.6 million) – a record result for the period. Light equipment and compact equipment were the strongest segments, reporting increases of 10 and 14 percent respectively. The Americas was the strongest regional revenue driver, with a rise of 22 percent. In Europe, revenue grew by 8 percent.

The CalChamber Alert newsletter reported October 26, 2012 that the California Air Resources Board has planned the state's first auction of carbon emission credits on November 14 as part of its program implementing AB 32, California's landmark climate change law. AB 32 set a goal of reducing greenhouse gas (GHG) emissions statewide to 1990 levels by 2020. The California Chamber of Commerce and other groups have been emphasizing that the auction is unnecessary to reduce greenhouse gas emissions and amounts to a multibillion-dollar hidden tax on carbon and therefore energy used by California businesses and consumers.

Michael Bernick, former California Employment Development Department Director & Milken Institute Fellow, posted an article on foxandhoundsdaily.com on November 15th, commenting on the changing work structure in California. The article points out the trend for replacing full-time payroll employment with independent contracting, outsourcing, and part-time employment -- a trend that is growing in all sectors, not just retail and hospitality.

Wayne Lusvardi, political commentator, recently posted his comments on a "split roll" property tax (from a longer piece on California’s economic growth titled "Supermajority Can’t Legislate Away Reality" published in Cal Watchdog) on foxandhoudsdaily.com. Lusvardi states, "The only political response to slow growth has been for the Party of Government to protect state and local governments, not businesses. Now the Democratic supermajority in the Legislature is rumored to have its eyes on eliminating Proposition 13 for commercial property taxation, which would create a 'split roll' property tax." In Lusvardi's opinion, "removing Prop. 13 for commercial properties would backfire because small businesses comprise 97 percent of total firms in California (857,167 small firms out of 878,120 total firms)."

CARB
Les Chayo, CRA's General Counsel, informed CRA that Mary Nichols, Chairman of the California Air Resources Board ("CARB") has agreed to delay certain aspects of the "Off-Road Diesel Emissions Rule" until 2014. The delay is expected to "save" the construction industry as much as $9 billion dollars. The agreement to delay "enforcement" resulted from disclosure of a study by the Associated General Contractors of America ("AGC") that identified a more than 300% overestimation of emissions from off-road diesel equipment by CARB. Following discussions with the AGC, CARB Chairman Mary Nichols agreed to "Stretching out the timelines in reporting requirements will make the path to compliance a lot easier while the construction industry recovers from severe financial hardships." Ms. Nichols opined that the "Added time will allow the marketplace to "create a turnover" of old equipment."

In December 2011, major amendments to the Off-Road Diesel Vehicle Regulation, which include delaying the first compliance date to no earlier than January 1, 2014, became effective. Owners or operators of portable engines and certain other types of equipment can register their units under the Air Resources Board's (ARB) Statewide Portable Equipment Registration Program (PERP) in order to operate their equipment throughout California without having to obtain individual permits from local air districts. For 2012, engine manufacturers are required to produce engines in all power categories that are certified to the Interim Tier 4 level. Engines that were produced under the "flex" provisions of either 40 CFR part 89.102 or 1039.625 will continue to be eligible for initial registration in PERP. On July 1, 2012, to apply for initial registration in PERP, all non-flex diesel engines rated 50 bhp and above must be certified to the interim Tier 4 emission standard. The fleet standards from the Portable Engine ATCM take effect January 1, 2013.

The regulation requires diesel trucks and buses that operate in California to be upgraded to reduce emissions. Heavier trucks must be retrofitted with PM filters beginning January 1, 2012, and older trucks must be replaced starting January 1, 2015. By January 1, 2023, nearly all trucks and buses will need to have 2010 model year engines or equivalent. The regulation applies to nearly all privately and federally owned diesel fueled trucks and buses and to privately and publicly owned school buses with a gross vehicle weight rating (GVWR) greater than 14,000 pounds. Small fleets with three or fewer diesel trucks can delay compliance for heavier trucks by reporting and there are a number of extensions for low-mileage construction trucks, early PM filter retrofits, adding cleaner vehicles and other situations.

The ARB's Heavy-Duty Vehicle Inspection Program and Periodic Smoke Inspection Program were adopted into law in 1988 to control excessive smoke emissions and tampering from heavy-duty diesel trucks and buses. The Heavy-Duty Vehicle Inspection Program (HDVIP) program requires heavy-duty trucks and buses to be inspected for excessive smoke and tampering, and engine certification label compliance. Any heavy-duty vehicle traveling in California, including vehicles registered in other states and foreign countries, may be tested. Owners of trucks and buses found in violation are subject to minimum penalties starting at $300 per violation. The Periodic Smoke Inspection Program (PSIP) program requires that diesel and bus fleet owners conduct annual smoke opacity inspections of their vehicles and repair those with excessive smoke emissions to ensure compliance. All vehicles that do not pass the test must be repaired and retested. A fleet owner that neglects to perform the annual smoke opacity inspection on applicable vehicles is subject to a penalty of $500 per vehicle, per year.
