The Noel Canning Decision – The D.C. Circuit’s Holding that the President’s Recess Appointments to the NLRB were Constitutionally Defective. On January 25, 2013, the U.S. Court of Appeals for the District of Columbia ruled that President Obama violated the Recess Appointments Clause of the United States Constitution on January 4, 2012, when he made three  recess  appointments to the National Labor Relations Board.

The growing shortage of primary care physicians has forced millions of Americans to seek care from emergency rooms and to delay or forgo needed care in some instances, which has resulted in higher rates of preventable illnesses and even deaths, according to a new report issued by the chair of a Senate subcommittee on primary health and aging.

Hospitals employed a seasonally adjusted 4.8 million individuals last month, 3,600 more workers than in December, according to data released from the Bureau of Labor Statistics. While national unemployment rose one percentage point in January to 7.9 percent, the health care sector saw employment grow by roughly 23,000 jobs. Much of the gains in health care jobs came from ambulatory health care services, which employed a seasonally adjusted 6.4 million in January, up 27,600 from the month before.

More than 80 percent of hospitals and health systems have short-term incentive plans for at least one of their executives, and CEO incentives usually average between 30 and 35 percent of base salary, according to data from Sullivan, Cotter and Associates.

Regardless of your politics around our nation's fiscal problems, we can probably agree that January and February are financially sobering for many of us. The holiday parties are over and the bills are coming due. In late January, just as credit card bills started to recover from end-of-year holiday spending, the FICA tax holiday expired, and paychecks contracted accordingly. The timing wasn't great for American workers, as salaries have plateaued over the past few years, only increasing 2.8 percent on average in 2012. They are projected to increase just 3 percent in 2013.

When Laurent Gueris took over the housekeeping department at Providence Little Company of Mary Medical Center in San Pedro, Calif., the staff of 15 was well-trained in cleaning, but any people skills they had, they'd picked up on their own. Some entered rooms without knocking, did their jobs wordlessly with heads down, and then rushed out. Wanting to be invisible, they instead came off as sullen and unhelpful. "They would do their little cleanup and leave," recalls Gueris' boss, Providence CEO Nancy Carlson. "They were very intimidated by other staff in the hospital and they were not being respected and valued."

Rude work behavior affects the bottom line, according to researchers from Georgetown University and the Thunderbird School of Global Management. Workers across sectors reported being treated rudely at least once a week, and that type of bad behavior is on the rise. Rude behavior influences productivity and commitment from workers, the researchers noted. Nearly half (48 percent) intentionally decreased their work effort as a result, while 38 percent intentionally decreased the quality of their work. What's more, 25 percent said they took out their frustration on customers, and 12 percent said they left their job because of incivility in the workplace.

As hospitals work to integrate their services, shrink their total cost of care, raise patient satisfaction, and drop their readmissions, employing or aligning with physicians of all specialties are in hospitals' sights. Staying knowledgeable on competitive compensation trends is important for health systems to be able to attract the talent and services they need to grow and improve, while ensuring compensation is appropriate to maximize financial resources. Although a few specialties experienced big pay increases over the last year, several median base salaries saw slight declines.

PwC’s annual Top Health Industry Issue report predicts that the pace of health care transformation will increase in 2013 because of technology, budget pressures, and the Affordable Care Act. But an overarching theme in many of the trends is the role of the patient and how consumerism is expected to drive the way health care is delivered, especially in the primary care setting.

The latest AHA TrendWatch report examines the gains hospitals have made in improving quality and patient safety, including reductions in health care-associated infections and adherence to accepted treatment protocols. In addition, the report highlights various strategies hospitals are employing to improve quality and patient safety. According to the report, hospitals use a variety of tested quality improvement approaches that generally involve five steps: identifying areas for improvement; determining what process can be modified to improve outcomes; developing and executing effective improvement strategies; tracking performance and outcomes; and disseminating results to spur broad quality improvement.

North Mississippi Health Services in Tupelo spent the better part of two years perfecting its practices, looking to score a prestigious Malcolm Baldrige National Quality Award, the nation's highest presidential honor for companies that embrace continuous performance improvement. But after winning in late 2012, it wasn't really the award that mattered the most. The six-hospital, community-owned health system subjected itself to hundreds of hours of review by Baldrige examiners, and finely tuned itself in seven categories of performance excellence, among them leadership, strategic planning, and customer focus.

Eleven top health care executives agreed that engaging patients was vital to reducing costs and waste while improving outcomes. In a Health Affairs article, executives from Hospital Corporation of America, Geisinger Health System, Intermountain Healthcare and Cleveland Clinic, among others, revealed that empowering patients at their institutions helped improve care at a better value.

William Jennings has served as president and CEO of Bridgeport (Conn.) Hospital, a 425-bed urban teaching hospital, since August 2010. Bridgeport Hospital has been affiliated with Yale New Haven (Conn.) Health System since 1996 and operates its own school of nursing, which is the longest-operating nursing school in the state. Under Mr. Jennings' tenure, the hospital rocketed from the 15th to the 88th percentile in its patient satisfaction scores, according to Press Ganey. In that same time, the hospital's operating margin increased from 1.3 to 7.5 percent and employee satisfaction sits comfortably at the 86th percentile for hospitals nationwide.
