Our rule was contained in what is known as a "rules bundle," a bill containing a number of rules proposed by an agency. As you may be aware, the Governor vetoed that bill. These are the species that were the subject of a joint letter to KY, VA and WV congressional delegations from the Kentucky Forest Industries Association, Virginia Forestry Association and WVFA in 2015. USFWS said in a news release that the Guyandotte River crayfish will be listed as endangered and the Big Sandy crayfish will be listed as threatened. A survey team in West Virginia found two isolated populations of the Guyandotte River crayfish in Pinnacle Creek and Clear Fork in Wyoming County. The Big Sandy crayfish was found at most previously known locations in the upper Big Sandy River watershed in Virginia, West Virginia and Kentucky. As a result of this correction, some counties will have increases in managed timberland taxes and others will have declines. But, to now stabilize county revenues, no managed timberland tax can decline more than 20% in one year from the previous year. There are approximately 2 million acres of 12 million forested WV acres that are affected. Since early 2013, when WVFA members began to receive their annual property tax invoices, our members have been working to correct the Managed Timberland Tax calculation. During what many call the Great Recession, as WV land prices declined, Managed Timberland taxes increased. This is a reverse of how the tax is supposed to work; i.e., it's tied directly to values of managed timberland - the appraised value for tax purposes. So, as values decline, taxes should likewise decline and vise versa. To address this problem, WVFA raised funds from our members to fund work by a WVU economist. That economist found that the state Department of Taxation was mixing nominal and real values in the same calculation: The nominal rate is the reported percentage rate without taking inflation into account. The real rate takes inflation into account (Real Rate = Nominal Rate &ndash; Inflation Rate). Located in the heart of the Appalachians, this camp site is surrounded by beautiful forests and streams, which will be utilized in the course of training during the week. Participants will be housed in camp and will be provided plentiful, hearty meals, along with social and recreational opportunities. Scholarships, which include meals, lodging, transportation while at camp, and insurance, will be paid by West Virginia Forestry Association and other interested individuals. The Forest Industry Camp has an annual budget of $3,500 and we have, thus far, raised $2,500 since the camp last year. Each camper will be responsible for transportation to and from camp and must provide his/her own bedding (two or three blankets are recommended if a sleeping bag is not available), towels, soap and other personal effects. Durable clothing is recommended, and since evenings could be cool, clothing should be warm and water-repellent. Leather boots, blue jeans and T-shirts are recommended. Campers should plan to arrive at camp between 2:00 p.m. and 4:00 p.m. Sunday, July 17, and depart camp immediately after breakfast on Saturday, July 23. There will be five full days of forestry training (8:00 a.m. - 5:00 p.m.). The first day and one-half (Monday and until noon Tuesday) will be devoted to the study of the forest ecosystem. Tuesday afternoon and Wednesday will be spent exploring forest management subjects. Thursday will be spent touring wood utilization firms in the area. Friday will be spent visiting a recreation area, and field events later in the day. Camp will break up after breakfast on Saturday, July 25. Evening programs will include swimming, canoeing and camp meetings. Every effort will be made to make learning an enjoyable experience. However, it should be understood that this camp is not the usual type of camp, in that the course is rigorous, demanding and rewarding, and participation is required in all class instruction. The House of Delegates had passed the legislation on a vote of 96-3, on Thursday. This version, among other things, reduces severance taxes on timber in our state to 1.50 percent and completely eliminates the tax in 2019. The bill was signed by the Governor, yesterday. You may recall a report here that the House Finance Committee passed the bill without a dissenting vote. In fact, every vote taken on elimination of the timber severance tax has been not even close; there were massive pro-elimination votes in 2015 and 2016, in committees and on the floors. In signing the bill, Gov. Tomblin said, "This legislation provides flexibility to fill the current year&rsquo;s budget shortfall, while keeping the promises of nearly 10 years ago." This echoed heartfelt remarks in the House Finance Committee that spoke to WV industries that have historically been promised reductions and/or eliminations without realizing them; even after those industries had done more than their share to fund state government. The scholarship may be revoked if the student fails to maintain the status of a full-time student or if the student does not maintain an overall 2.0 GPA or is suspended from the academic institution. The student is obligated to provide the WV Tree Farm Committee with a copy of grades each semester/quarter covered under the scholarship to prove full-time status and GPA. This scholarship is intended to assist the child or grandchild of a West Virginia Tree Farmer in their pursuit of a higher education. Only one Republican &ndash; U.S. Rep. Chris Smith of New Jersey &ndash; voted against the measure. The rule was published in the Federal Register June 29. The EPA and the U.S. Army Corps of Engineers began enforcement Aug. 28. However, a federal appellate court in October issued a decision that stops the EPA and Corps from enforcing the rule. A WVU economist found why this happened; including, mixed values (nominal and real dollars in same formula) and non-statutory dollar-constants below which land values could not fall. Some time ago, this information was submitted to the State Tax Commissioner and, in an amicable response, the tax office agreed that a fix is needed. Recently, we also reported that the legislature&rsquo;s Rule-Making Committee passed the rule as needed to allow its introduction in the next session of the legislature. But, in a surprise move by the WV Tax Department, the rule was withdrawn, at the end of last week. The U.S. Occupational Safety and Health Administration says Ray Clearing Inc. of Bickmore also was issued one other-than-serious citations. The citations stem from an inspection by OSHA&rsquo;s Charleston Area Office at a site in Cabin Creek on Aug. 4. The agency said... in a news release that the serious violations included employees without heavy duty logging boots and other proper protection using chainsaws to fell trees. Other serious violations included permitted employees to ride as passengers on mobile vehicles without a seat belt and assigned seat, exposing them to falls and crushing injuries. The annual A. B. Brooks Memorial Forestry Symposium was inaugurated in 1986 to honor and commemorate West Virginia&rsquo;s first and most illustrious forester. His full name was Alonzo Beecher Brooks, although he was simply "A. B." to friends and acquaintances. He was born May 6, 1873. The Brooks family lived near French Creek, Upshur County, West Virginia, on a typical West Virginia hill farm. There was no money for college; so he taught himself plane surveying and began the preparation of a map that included every road and every dwelling (outside the corporate limits of Buckhannon) in Upshur County. In 1905, the map was completed and sales provided funds for his entrance to West Virginia University. Since there were few public high schools, A. B. spent two years in college preparation courses, then began a baccalaureate program (1908) which included the first forestry courses ever offered at the university. He was a member of the first graduating class that had instruction in forestry. He then accepted an appointment as forester from the West Virginia Geological Survey (1910-1911) to collect data for, and to prepare, a survey of West Virginia&rsquo;s forest resources, county by county. This detailed study resulted in a book of 486 pages and was published as Forestry and Wood Industries, Volume 5 of the West Virginia Geological and Economic Survey, in 1911. It is the classic on the State&rsquo;s early forest conditions and resources. Brooks later served as forester for the West Virginia Agricultural Experiment Station, where he worked on a program concerned with stopping the spread of chestnut blight. From West Virginia, he moved to the state of New York and spent two years in its Conservation Department. After this, he returned to West Virginia where he soon published a 242-page book (West Virginia Trees). This book included identification data, descriptions, ranges and a detailed drawing of every tree species known to occur within the state. Originally published by West Virginia University in 1920, it was reprinted in 1951 and republished in 1972. In 1921, West Virginia&rsquo;s first Conservation Commission was established, and A. B. became its first director with the title of Chief Game Protector. Under his administration, the first state forest (Seneca) and the first state park (Watoga) were established. When Colonel E. W. Oglebay left his 700-acre Waddington Farms to the city of Wheeling, a recreational and educational program of music, nature study, handicrafts, horticulture and other cultural activities was instituted. A. B. became Oglebay Institute&rsquo;s first Staff Naturalist. His Sunday morning bird walks along Oglebay&rsquo;s trails gradually developed into the internationally famous Brooks Bird Club. US EPA, 344 F.3d 832 (9th Cir. 2003) (EDC v. EPA). In that case, EDC contended that EPA arbitrarily failed to regulate discharges from forest roads under the Phase II rule. The court held that EPA failed to consider the petitioners&rsquo; comments and remanded the issue to EPA &lsquo;&lsquo;so that it may consider in an appropriate proceeding Petitioner&rsquo;s contention that section 402(p)(6) requires the EPA to regulate forest roads. The EPA may then either accept Petitioners&rsquo; arguments in whole or in part, or reject them on the basis of valid reasons that are adequately set forth to permit judicial review.&rsquo;&rsquo; Since 2003, EPA did nothing to address the 9th Circuit Courts remand. A congressional informational field trip visited some private stewardship practices and the WV group made good contacts with staffers. Randy and other state foresters are working on a policy for wildfire disaster funding. One impact of wildfires this year was that $2.5 million in Forest Legacy funds were turned back to help fight fires. This wildfire policy would treat wildfires as a disaster similar to hurricanes and ease concerns with the USDA FS budgeting process. Randy was elected president of National Association of State Foresters Foundation (forestry education) and West Virginia got the bid to host 2017 annual meeting for NASF. Background In its 2010 Greenhouse Gas Tailoring Rule, EPA for the first time failed to distinguish biogenic CO2 emissions from fossil fuels and thus did not exclude biogenic CO2 from its Clean Air Act permit program for stationary sources. However, because bioenergy has a uniquely different profile than fossil fuels, in 2011 EPA imposed a three-year deferral of regulating biogenic CO2 pending a scientific review and the development of an Accounting Framework for Biogenic CO2 Emissions from Stationary Sources. EPA&rsquo;s original draft, Accounting Framework, issued in September 2011, recognized the greenhouse (GHG) gas reduction benefits of bioenergy produced from forest product mill residuals and byproducts. Yet, because the deferral of biogenic emission regulation expired, biogenic CO2 emissions are counted the same as fossil fuel emissions under EPA&rsquo;s current and proposed greenhouse gas regulations. On Nov. 19, 2014, after an extensive four-year review, EPA issued its revised draft accounting framework, 14 technical appendices, and a related policy memorandum to EPA&rsquo;s regional offices. Key Points from EPA &bull; In the policy memorandum, EPA makes a preliminary finding that the use of certain forest-derived industrial byproducts and waste-derived feedstocks for energy is carbon neutral. &bull; In the appendices, EPA unequivocally finds that black liquor is carbon neutral. &bull; In addition, EPA indicates that the use of whole trees, or roundwood, for energy may be carbon neutral so long as they are "sustainably derived," but it is unclear how that determination would be made. The agency says in a news release that inspectors found workers were drop starting chain saws while felling trees. Drop starting is dropping the chain saw with one hand while pulling the starting cord with the other hand. Workers also didn&rsquo;t wear cut-resistant boots or socks while operating chain saws. The agency issued 11 citations to the company, including two for willful violations. Employees were unloading enormous tree trunks, feeding roaring saws, and sorting wood by source and grade. Those activities are signs the Smoot sawmill is making a comeback after a blaze engulfed the facility in December 2013, destroying half of the production building where timber is cut and sorted. About 150 people gathered Monday to eat pork barbecue, cole slaw and potato salad as the mill&rsquo;s parent company, Allegheny Wood Productions Inc., officially reopened the completely rebuilt facility. AWP&rsquo;s President John Crites II (pictured second from left) told the audience the company is dedicated to Smoot and operating "this mill in this community." The mill was one of three purchased from Beckley&rsquo;s New River Hardware in late 2014. The rebuilding allowed AWP to convert the sawmill into a state-of-the-art facility. During a tour, visitors observed sawyers using lasers to properly align timber and consulting information panels for instructions. The mill&rsquo;s 28 employees returned to the Smoot sawmill last month after nearly a year of traveling to another sawmill in Beckley. When the Smoot facility reopened, all new equipment was purchased as part of $3 million in additional investments to the acquisition costs, company officials said. US. V. Citgo Petroleum Corporation, et al., case number No. 14-40128, in the U.S. Court of Appeals for the Fifth Circuit (Louisiana, Mississippi, and Texas). Looking toward the Eighth and Ninth Circuits that a "taking" is limited to deliberate acts done directly and intentionally to migratory birds, the Fifth Circuit concluded that the MTBA convictions for the death of migratory birds that landed in uncovered tanks must be reversed. Referring to the common law definition of take, the Court concludes, "one does not reduce an animal to human control accidentally or by omission; he does so affirmatively." The opinion emphasizes the fact that the MTBA definition of "take" does not include qualifying terms like "harm" or "harass" which would had signaled Congress&rsquo; intent of expanding the term to include negligence or unintentional acts. The Fifth Circuit decision rejects the MTBA decisions rendered by the Second and Tenth Circuits. The Court distinguishes its opinion from those decisions by emphasizing a review of the definition of "take." There are approximately 82,000 family forests and 24 million acres in the program. Board of Directors, working with the American Loggers Council (WVLC), has determined to work more closely with WV loggers at loggers&rsquo; direction and within the bounds of the WVFA mission. Therefore, was be a meeting of interested loggers and others at the Canaan Resort and Conference Center, near Davis, WV, on Saturday, July 11, in order to begin a "WV Loggers Council." The meeting was held to review initial documents needed to form the group, elect directors of the Council and to learn about any issues of interest to the WV logging community that may be addressed by the group and/or advocated for by the WVFA at the WV capitol. A set of draft by-laws was presented to the 22 loggers and logger-representatives gathered. Certain edits were made to the document and that updated charter will be published by WVFA, soon. The WVLC determined that logging representatives should be chosen from each of the six WV Areas used by WVFA, plus one from the Mountain Loggers Cooperative Association. The initial Executive Committee of the Council are: Anthony Raines, Rick Smith, Jerry Huffman, Jay Johnston, Curt Hassler, Donald Parker and the group elected Harry Vance as Chair. This year&rsquo;s meeting began Thursday morning with the wood-preservation seminar with a first aid/CPR/BBP component and afternoon gatherings of the Logging/Safety, SFI and Legislative Committees, with the Board of Directors meeting that evening. More joined their friends on Friday to take part in WVFA events: golf tournament, skeet shooting and horseshoe & corn hole tournaments. The customary family BBQ was held again, with a shuttle to opportunities for chair-lift rides and the turtle-slides. Randall Wolfe, Donald Parker and Wayne Wolfe have been in the logging business since June of 1988. They have worked for Westvaco (now WestRock), Newpage Corp., Neff Lumber and, most recently, AWP. They have previously earned Logger of Excellence recognition from the WV DOF and are true Stewards of the forest. They are also Region 2 Loggers of the Year. As members of WVFA, Wolfe and Parker Logging practice promote and comply with all state and local sediment control laws and regulations, as well as those in Maryland and Virginia. We find that this is caused by an invasion of yellow poplar weevils; the black beetle native to our state. "The weevils have been here since before people settled this country. This is not something new. Some years are worse than others. This is one of those years," according to West Virginia Department of Agriculture Plant/Pest Biologist, Dr. Berry Crutchfield in a recent statement to WBOY News in Morgantown. Most healthy poplar trees will be able to withstand the damage. But they will transformed by the encounter.
