Of total hospital costs in 2013, the five most expensive conditions accounted for 20.5% of total costs. Septicemia was the most expensive condition followed by osteoarthritis. Septicemia accounted for $23.7 billion (6.2%) of the total costs for all hospitalizations, and osteoarthritis, $16.5 billion (4.3%). Included in the top 20 most expensive inpatient conditions, in order, were congestive heart failure; spondylosis, intervertebral disc disorders and other back problems, among the other medical conditions.

As a part of its continued efforts to assess compliance with HIPAA, the HHS Office for Civil Rights (OCR) has begun its next phase of audits of covered entities and their business associates. Every covered entity and business associate is eligible for an audit. OCR will send an email to covered entities and business associates to be audited. Such communications may be incorrectly classified as spam. The OCR states "We expect entities to check their junk or spam email folder for emails from OCR." The email requests that contact information be provided in a timely manner. If an entity does not respond to OCR’s request to verify its contact information or pre-audit questionnaire, OCR will use publicly available information about the entity to create its audit subject pool. Therefore an entity that does not respond to OCR may still be selected for an audit or subject to a compliance review. "We encourage covered entities to prepare a list of each business associate with contact information so that they are able to respond to this request," says the OCR.

According to common physicians, obesity is a chronic disease. New evidence-based guidelines for treating obesity have been developed and, surprise, a pharmacological aspect is "the engine of the guidelines." While consistently harping about "public safety" an array of wound care products has flooded the marketplace with untested and unproven claims about their wound healing capabilities. Because of a regulatory loophole, non-FDA-approved products are able to make the same wound healing claims as FDA-approved living cell therapies, but many in the wound care profession are unaware of the full story behind the products they are using.

Medicaid coverage for millions of patients may have expanded, but there’s no clear picture that it has markedly improved access and quality of care. That’s in part because inadequate physician payment in many states has kept many practice doors closed to this population. Low payment for doctors in many states are cited as a key factor in keeping the expansion’s true impact below its potential. The AMA plans to press the Centers for Medicare & Medicaid Services to make sure states set physician payment rates "at levels to ensure there is sufficient participation.

"Every day, 44 people in the United States die from prescription drug overdoses, especially opioid overdose. A research report demonstrates "suboptimal" practices related to sharing, storing, and disposing of opioids, as well as poor communication of information on these topics to patients. Medical hospitalizations were most likely for connective tissue or musculoskeletal disorders.

The Texas Board of Chiropractic Examiners (TBCE) at their May meeting proposed several rules amendments.Proposed changes are to rules 72.6, 74.1, 74.2, and 78.6. The proposals serve: toupdate rules to reflect present process and procedure concerning examinations; to clarify definitions; reflect the transfer of administration duties from the Department of State Health Services (DSHS) to the Texas Medical Board (TMB); andupdates the present fee for the TBCE’s jurisprudence examination.

The Supreme Court skated right down the middle in a unanimous decision regarding what constitutes a false claim under the federal False Claims Act (FCA). Suit was filed under the FCA on the theory that even though the claims submitted to Medicaid for payment by the clinic accurately represented the services that were provided, the claims were false because the clinic had not complied with state laws. The court's ruling will make things more complicated for both sides in these types of cases going forward.

The House of Representatives passed 18 bills related to opioids earlier this month, and the Senate approved a comprehensive bill in March. The American Chiropractic Association applauded the recent passage of several bills by Congress as a major first step in combating the nation's opioid epidemic. An important next step, according to ACA, is expanding access to conservative treatments for pain in the country’s health care system.

The American Chiropractic Association is looking for a few good men and women to assist the association with responding to the nation's opioid epidemic. Members with expertise in pain management and public health policy are urged to apply to serve on a new Opioid Task Force that will periodically advise staff on projects such as public statements and other strategies to promote chiropractic as a first line of defense for pain management. A new study has called into question the standards used by the U.S. Food and Drug Administration to approve new cancer drugs and whether those drugs are helping patients live longer or proof of improved quality of life. According to the study, "The problem today is that we have a plethora of drugs that were approved but follow-up data has not been appropriately obtained and published. We therefore may be harming patients, by giving drugs that don’t work and have significant side-effects.On average, the treatment cost of those drugs cost is about $10,000 a month.

The FDA warned that older adults and those with bleeding risk factors should choose antacids that don’t contain aspirin, noting continued cases of serious bleeding. Did you know that in your everyday practice you are financially and legally responsible for providing qualified auxiliary services to patients seeking your skills? If you do not comply, you can be sued for providing inadequate communication due to a patient’s disability and the provider's refusal to secure an interpreter or other adequate auxiliary services.

In its latest attempt to restrict trade, "organized medicine"  seeks to eliminate from the federal registry chiropractic doctors who are federally Certified Medical Examiners (CME). In Texas, the federal registry lists an estimated 400 federal CMEs. Of these, approximately 16.25% are doctors of chiropractic. By questioning the DC's scope of practice, all DC CME’s in New York have been decertified from the National Registry. So what is the New York Model?

In May, the American Chiropractic Association responded to a video on the MSN homepage that perpetuates misinformation that is harmful to health care consumers. ACA objected to the video, "A Neurologist Explains Why Going to a Chiropractor May Be a Waste of Money," featuring neurologist Steven Novella. ACA considers the article "a one-sided rant clearly intended to smear the reputation of the profession in the minds of health care consumers." In particular, Dr. Novella’s statements that chiropractors "do essentially what they want" is a blatantly false statement, according to ACA. Read ACA’s full letter to MSN in this article.
