In Memory of Raymond Andrew Burns
Raymond A. Burns "Ray" died on May 24, 2016 in Idaho Falls, ID. He was 84 years old. Raymond was the founder and owner of Gem State Rentals for 40 years. He loved working in the community and serving his neighbors. He was active in the American Rental Association (ARA) for 58 years where he served as President. He was also President of the American Rental Dealer Insurance or ARDI. Laird Burns, Raymond's son, is a former CRA Board Member.

Major Changes Effective January 1, 2016
On October 3, 2013, Governor Jerry Brown signed into law AB 529 (Vehicles: motor carriers: inspections and fees – AKA: BIT Reform bill) sponsored by Assembly Member Bonnie Lowenthal. The bill was supported by all major trucking associations in California including the California Construction Trucking Association. AB 529 will significantly alter the Biennial Inspection of Terminal (BIT) program and how motor carriers are prioritized for a terminal inspection. For starters, the program will be called the Basic Inspection of Terminal program. The intent behind reforming the BIT program is to allow CHP to more closely target its limited human resources (inspectors) to focus on unsafe motor carriers. Bluntly, if you’ve always received a satisfactory terminal rating, chances are you will always get a satisfactory rating so why should you continually face a terminal inspection? You won’t as long as your crash history and safety data from all inspections indicates good safety management practices are in-place.

Workers’ compensation insurers and some self-insured employers have employees who examine claims after they are submitted for payment. In workers’ compensation, benefits are mandated by law, so examiners who work for workers’ compensation insurers review a claim to ensure it meets the law’s definition of a compensable work-related claim. If a claim meets that definition, the examiner will review it to ensure claimants receive any lost-time benefits due to them.

How to Apply New Federal Overtime Rule to Outside Salespeople
Does the new federal salary requirement apply to our outside salespeople who receive a monthly salary? No. Neither federal nor California law require the payment of either minimum wage or overtime for an outside salesperson position that meets certain duties tests. The federal overtime rule taking effect on December 1, 2016 under the Fair Labor Standards Act (FLSA) applies to the Executive, Administrative, and Professional exemptions that are subject to a salary basis test.

• SB 1069 (Wieckowski; D-Fremont) Increases Housing Supply: Creates and expedites additional housing supply by streamlining the permitting process for Accessory Dwelling Units. Assigned to the Assembly Housing and Community Development Committee and Assembly Local Government Committee; no hearing date set.
• AB 2664 (Irwin; D-Thousand Oaks) Increased Innovation and Entrepreneurship: Makes it easier to establish a business by expanding capacity and increasing access to the University of California (UC) and Berkeley National Laboratory to their innovation and entrepreneurship centers, which provide incubator space, legal services, entrepreneur training and more for researchers and other individuals looking to develop innovative solutions. In Senate Rules awaiting policy committee assignment.
• SB 936 (Hertzberg; D-Van Nuys) Loan Access: Encourages creation of small businesses by expanding their access to loans, which helps them grow. Assembly Jobs, Economic Development and the Economy Committee hearing June 21.

Only four job killer bills subject to the June 3 deadline for bills to pass the house in which they were introduced have moved on to the second house. The remaining four subject to the deadline were stopped or amended on the Assembly Floor. The deadline was waived for a fifth bill before amendments led to the California Chamber of Commerce removing the job killer tag while remaining opposed.

The United States added 34 million barrels (6%) of working crude oil storage capacity from September 2015 to March 2016, the largest expansion of commercial crude oil storage capacity since EIA began tracking such data in 2011 (Figure 1). At the same time, reported weekly U.S. commercial crude inventories have increased by more than 72 million barrels (16%) since September, which implies crude oil storage capacity utilization at a record high of 74% for the week ending June 3.

Owners or operators of portable engines and certain other types of equipment can register their units under the Air Resources Board's (ARB) Statewide Portable Equipment Registration Program (PERP) in order to operate their equipment throughout California without having to obtain individual permits from local air districts. The following sections will assist you with the PERP registration process and present facts on the Portable Diesel Engine Airborne Toxic Control Measure (ATCM).

On July 26, 2007, the Air Resources Board (ARB) adopted a regulation to reduce diesel particulate matter (PM) and oxides of nitrogen (NOx) emissions from in-use (existing), off-road, heavy-duty diesel vehicles in California.

A fleet average calculator for small fleets has been made available for public use. The small fleet average calculator is for small-sized, off-road fleets (2,500 or less total horsepower) and covers all compliance years. The calculator is available here. Fleet owners utilizing the calculator are advised to first read the User Guide in order to familiarize themselves with the calculator.

The regulation requires diesel trucks and buses that operate in California to be upgraded to reduce emissions. Lighter and older, heavier trucks must be replaced starting Jan. 1, 2015. By Jan. 1, 2023, nearly all trucks and buses will need to have 2010 model year engines or equivalent. The regulation applies to nearly all privately and federally owned diesel-fueled trucks and buses and to privately and publicly owned school buses with a gross vehicle weight rating (GVWR) greater than 14,000 pounds.

This area of the Off-Road Mobile Sources website pertains to off-road, large spark-ignition (LSI) equipment greater than 25 horsepower, including farm, construction and industrial equipment, powered by gasoline and liquefied petroleum gas (LPG) and other alternate fuels. Typical applications that use LSI engines include forklifts, specialty vehicles, airport service vehicles, large turf-care equipment, portable generators and a wide array of other agricultural, construction and general industrial equipment. The U.S. EPA has sole authority to control new farm and construction equipment under 175 horsepower.

The ARB's Heavy-Duty Vehicle Inspection Program and Periodic Smoke Inspection Program were adopted into law in 1988 to control excessive smoke emissions and tampering from heavy-duty diesel trucks and buses. The regulations Title 13 CCR, sections 2180-2189 for HDVIP and Title 13 CCR, sections 2190-2194 for PSIP, which govern these programs, were last amended in 2013.

The HDVIP program requires heavy-duty trucks and buses to be inspected for excessive smoke and tampering and for engine certification label compliance. Any heavy-duty vehicle traveling in California, including vehicles registered in other states and foreign countries, may be tested. Tests are performed by ARB inspection teams at border crossings, CHP weigh stations, fleet facilities and randomly selected roadside locations. Owners of trucks and buses found in violation are subject to minimum penalties starting at $300 per violation.
