CalChamber's recent Alert Newsletter reported that federal employers with 50 or more employees are required to display an updated federal family leave poster starting March 8. The final rule outlining the requirement was by the U.S. Department of Labor (DOL) to implement federal laws expanding Family and Medical Leave Act (FMLA) protections. The FMLA applies to employers with 50 or more employees. The FMLA changes were legislated by the National Defense Authorization Act for Fiscal Year 2010 and the Airline Flight Crew Technical Corrections Act (signed in 2009). The regulations were issued for public comment February 15, 2012, and the comment period closed on April 30, 2012.

Historically, Cushing, Oklahoma has served as the mid continent hub for distribution of both crude oil imported to the U.S. Gulf Coast and West Texas crude oil production. Pipelines were constructed and configured to move crude oil north to Cushing, and then on to refineries throughout the Midwest. However, as crude oil production has grown in the U.S. mid continent and Canada, the Cushing hub has become over-supplied. As a result, market participants increasingly have been looking to relieve bottlenecks at Cushing by reconfiguring and expanding pipeline infrastructure to move crude oil south to the Gulf Coast refineries. Over the next two years, planned additions to pipeline takeaway capacity should be sufficient to ameliorate the current imbalance at the Cushing hub. Part of a supplement to the Energy Information Administration's (EIA) February Short-Term Energy Outlook focuses on this changing infrastructure.

The February 15th CalChamber Alert newsletter reported that Covered California, the state-run program that oversees implementation of the Affordable Care Act, this week released the standards for benefit plans that will be made available to Californians who do not rely on employer-provided insurance or Medi-Cal for health care coverage. Four plan levels will be available: bronze, silver, gold and platinum. The percentage of coverage to be paid by the health plan ranges from 60 percent for bronze to 90 percent for platinum. More than 2.6 million Californians will be eligible for subsidies, according to Covered California.

He states, "Since that landmark anti-tax measure passed in 1978, California has become an increasingly selfish state. A growing number of people are voting the "What’s-In-It-For-Me?" ticket, reducing almost every call for increased spending, program cuts and new state priorities to a simple question of personal benefit rather than a decision based on California’s needs. Call it, once again, the law of unintended consequences. When Prop. 13 went on the California ballot, it was designed to stop skyrocketing property tax hikes that were forcing low-income seniors from their homes."

Jack Humphreville, writer for CityWatch, President of the DWP Advocacy Committee, Ratepayer Advocate for the Greater Wilshire Neighborhood Council, and Publisher of the Recycler Friday, reported on February 15th that on the prior Wednesday, the Los Angeles Times urged a NO vote on Proposition A, the PERMANENT half cent increase in our already regressive sales to a staggering 9.5 percent, one of the highest rates in the country. While The Times conceded that there might be some "short term pain" if Proposition A is defeated, the Editorial Board recommended that any increase be determined by the new Mayor and the City Council which will have seven new members, and only after completing the upcoming labor negotiations with the City’s labor unions. Any increase in the sales should also be part of a "long-term budget fix."

The Truck and Bus regulation will reduce diesel exhaust emissions from privately owned and federal government diesel trucks and buses. Privately and publicly owned school buses have different requirements and do not need to be reported. On July 26, 2007, the Air Resources Board (ARB) adopted a regulation to reduce diesel particulate matter (PM) and oxides of nitrogen (NOx) emissions from in-use (existing) off-road heavy-duty diesel vehicles in California. Owners or operators of portable engines and certain other types of equipment can register their units under the Air Resources Board's (ARB) Statewide Portable Equipment Registration Program (PERP) in order to operate their equipment throughout California without having to obtain individual permits from local air districts. For 2012, engine manufacturers are required to produce engines in all power categories that are certified to the Interim Tier 4 level. Engines that were produced under the "flex" provisions of either 40 CFR part 89.102 or 1039.625 will continue to be eligible for initial registration in PERP. On July 1, 2012, to apply for initial registration in PERP, all non-flex diesel engines rated 50 bhp and above must be certified to the interim Tier 4 emission standard. The fleet standards from the Portable Engine ATCM take effect January 1, 2013.

The regulation requires diesel trucks and buses that operate in California to be upgraded to reduce emissions. Heavier trucks must be retrofitted with PM filters beginning January 1, 2012, and older trucks must be replaced starting January 1, 2015. By January 1, 2023, nearly all trucks and buses will need to have 2010 model year engines or equivalent. The regulation applies to nearly all privately and federally owned diesel fueled trucks and buses and to privately and publicly owned school buses with a gross vehicle weight rating (GVWR) greater than 14,000 pounds. Small fleets with three or fewer diesel trucks can delay compliance for heavier trucks by reporting and there are a number of extensions for low-mileage construction trucks, early PM filter retrofits, adding cleaner vehicles and other situations.

The ARB's Heavy-Duty Vehicle Inspection Program and Periodic Smoke Inspection Program were adopted into law in 1988 to control excessive smoke emissions and tampering from heavy-duty diesel trucks and buses. The Heavy-Duty Vehicle Inspection Program (HDVIP) program requires heavy-duty trucks and buses to be inspected for excessive smoke and tampering, and engine certification label compliance. Any heavy-duty vehicle traveling in California, including vehicles registered in other states and foreign countries, may be tested. Owners of trucks and buses found in violation are subject to minimum penalties starting at $300 per violation. The Periodic Smoke Inspection Program (PSIP) program requires that diesel and bus fleet owners conduct annual smoke opacity inspections of their vehicles and repair those with excessive smoke emissions to ensure compliance. All vehicles that do not pass the test must be repaired and retested. A fleet owner that neglects to perform the annual smoke opacity inspection on applicable vehicles is subject to a penalty of $500 per vehicle, per year.
