CFTC Grants Public Power Petition on Sub-Threshold
On March 21, the Commodity Futures Trading Commission (CFTC) issued a temporary No-Action Letter that effectively implements the changes sought by the "Public Power Risk Management Act." However, because it is not codified in law, APPA and others will continue to encourage CFTC to issue a formal rule and also push for enactment of S. 1802/H.R. 1038 on Capitol Hill.
Municipal utilities are cautiously optimistic that the development could bring lost counter-parties back to the table immediately. The CFTC still plans to discuss the issue at an April 3 Roundtable on energy end-user issues, including the $25 million sub-threshold for "Special Entities," including municipal utilities.
