GCAC Report Regarding Federal Prompt Payment

In other information, we understand that the government of British Columbia is considering an outreach to get information but does not consider it a priority at this time.

In Saskatchewan, the Saskatchewan Construction Association, along with their ADR Institute, have made a joint notation to become that province's ANA.

In Alberta, the government has reached out for feedback and Matt Ainley will be meeting with the government in the near future, and is working with our chapter in Alberta to provide responses.

There are no further updates from other provincial areas at this time; however, we will keep all members apprised as both the federal and other provinces move forward on developing these practices.

Federal Report
We have received a quick update on the federal government's activities related to prompt payment. As you know, they were unable to move forward during the federal government’s caretaker convention period – while the federal election was occurring. Now that the election period has passed and government is now back in action, they plan to move forward with their next steps.

Those next steps are: 

  • Add “Proper Invoice Received Date” to PSPC payment disclosure website (completed)
  • PSPC to develop its draft policy position related to regulations (well underway – 95% complete)
  • Once the policy position is developed and prior to regulation drafting, we will share the policy position with you for feedback
  • We are consulting with the province of Ontario on its lessons learned and recent experience regarding the establishment of its adjudicator authority
  • Lessons learned will be considered/inform the federal Adjudicator Authority RFP – RFP will be active after the regulations are published
  • FPT outreach for collaboration/alignment opportunities continues (although we have received limited interest)

Ongoing movement on completion of the four remaining action-plan items (part of the 14-point Action Plan), noting some dependency on completion of regulations:

  • Holdback
  • Metrics
  • Education
  • Codes and protocols 

Once they are in a position to share their policy position, we will be back in contact.
