A complaint issued by the NLRB’s Hartford regional office last week claims that a company illegally terminated an employee for posting negative comments about her supervisor on her Facebook page. The complaint also alleges that the company, American Medical Response of Connecticut, Inc. (AMR), illegally denied union representation to the employee during an investigatory interview, and maintained and enforced an overly broad blogging and Internet posting policy.

Since 2008, both the U.S. Congress and the Department of Labor (DOL) have brought significant changes to the 17-year-old law. In large part, these developments embody attempts by lawmakers to address issues important to families affected by military service and diverse or "non-traditional" families. These recent amendments (impacting both the FMLA statute and associated regulations) and administrative interpretations underscore the importance to employers of ensuring that human resources personnel and leave administrators are fully aware of the changes and clarifications and that FMLA policies are updated and current.

Some employees will likely be unhappy they can’t sock away more in 2011 for retirement than they did this year – at least not through payroll deductions. The Consumer Price Index didn’t meet the statutory thresholds that cause them to increase, which means many of the 2011 contribution limits will be unchanged from 2010.

The majority of employee survey work is done once a year, or in fact, every two years. This is an odd cycle given that financial data, sales data, and almost every other piece of business data collection work done within organizations is at a much higher frequency rate. If an organization’s goal is to help drive performance with employee feedback, then more frequent data are essential. And if an HR team is in the business of delivering high-quality coaching to managers, then fast and frequent data are required.

Can’t say we’re surprised: Employees are planning to postpone retirement. They’re trying harder to become debt-free. And they’d be willing to hand over more of their pay if it means better retirement and health care benefits. A recent survey from HR consultant Towers Watson found that 40 percent of workers are planning to retire later than they were two years ago.

Over half of HR and compensation professionals feel they are underpaid, according to a recent poll. However, while the percentage of respondents who feel they are underpaid is still high (54 percent), it is lower than the results from two years ago (71 percent).

Wage and hour violations are "rampant" in American workplaces, according to a survey cited by California attorney Laura Innes. Innes spoke at BLR’s National Employment Law Update in Las Vegas, NV.

When Bill Clinton was strategizing his successful presidential run in 1992, his campaign came up with three topics to help focus his message, especially in the post primary push into the election. He focused on: 1. Change vs. status quo 2. Health care 3. It’s the economy, stupid Although President George HW Bush was fairly popular with several foreign policy victories, the recession at home lingered and Clinton continued to hammer home a weakness. That, with a little help from Ross Perot, pushed Clinton over the top. With some in HR bruised and battered from the recession, we can often lose focus with so many priorities floating around the world of the new normal. Take a page from Clinton’s book and focus: It’s the people, stupid.

"Most [employee] evaluation processes hurt rather than help. They are formal, infrequent, and often tied during a specific meeting to discussions of money, all of which make having a real give and take, a real dialogue about performance extremely difficult," comments Todd Dewett, Ph.D., a business consultant and a professor of management in the Raj Soin College of Business at Wright State University in Dayton, Ohio.

Managers cherish those staffers who’ll go the extra mile, take on that one last chore, or cheerfully step up when a fellow employee’s in need. Just one problem: Their co-workers hate them. At least that’s what Washington State University psychologist Craig Park says his research indicates. In four separate Park-led studies, those unselfish workers turned out to be the ones co-workers disliked most.

Employee burnout’s not a funny issue for today’s employers. But you can’t help laughing at some of the wild excuses employees come up with to justify being a no-show at work. CareerBuilder’s annual survey on absenteeism shows 29 percent of workers have played hooky from the office at least once this year, calling in sick when they were well.

If there’s one good thing that’s come from all the turmoil and stress caused during the last few years of economic downturn, it’s this – people are much more appreciative of many things that they used to take for granted. We know this because of surveys like the latest one from Mercer, the giant global provider of consulting, outsourcing, and investment service. It found that 90 percent of employees believe that the benefits they receive from their employer are as important as the salary they bring home.

American workers often do not take all their vacation days, according to the "Wellness in Travel" study of 1,500 Americans undertaken by Westin Hotels & Resorts. The survey report states that more than half of Americans do not take all their vacation time. According to the report, "More than half (58 percent) of respondents say they feel they are in more need of vacation than last year and 64 percent have canceled vacation due to work worries."
